In a crusade against Jovem Pan, Sleeping Giants suffers another defeat in court

The São Paulo Court imposed a new defeat on Sleeping Giants Brasil by denying an appeal and disqualifying a request from activists against the judicial decision in favor of Jovem Pan, in a decision taken this Wednesday (24) by judge Gilson Delgado Miranda.

The judges at the São Paulo Court of Justice refused the motions for clarification presented by the activist group, which sought to restrict the effectiveness of the previous decision, allowing attacks on the media group to continue in other ways.

Miranda highlighted that the unanimous decision of the 35th Chamber of Private Law was broad and unrestricted, aiming to immediately cease the defamatory campaign against Jovem Pan. The ruling highlighted the prohibition of the “#DemonetizaJovemPan campaign” or any similar campaign, making it clear that Sleeping’s attempt Giants to restrict the scope of the decision would not be accepted.

“It was not for nothing, in fact, that the Judging Panel determined the cessation of the ‘#DemonetizaJovemPan campaign’ or any other similar campaign against the currently embargoed which, strictly speaking, already provides enough support to understand the extent of the command, which cannot be restricted in the way intended by the embargoers”, wrote the judge.

The previous decision of the São Paulo Court was maintained when it considered the activist group’s campaign against Jovem Pan as illegal and ordered its immediate interruption. The company’s defense lawyer, José Frederico Manssur, states that the judges confirmed the illegality and unconstitutionality of Sleeping Giants’ action.

“Another defeat in court for the activist group, which tried, through embargoes, to restrict the effectiveness and scope of the judicial decision, to, in some way, continue with the campaign against Jovem Pan”, he stated.

O People’s Gazette contacted Sleeping Giants to comment on the magistrate’s decision and is awaiting a response.

At the beginning of this year, the São Paulo Court condemned Sleeping Giants Brasil for a defamation campaign against Jovem Pan, ordering the exclusion of publications. The 9th Civil Court of the state Court of Justice considered the defamatory campaign as an affront to the company’s image and honor, going beyond the “legitimate limits of freedom of expression”.
