Pre-candidate released mixed research data forming a “frankenstein survey”

Sao Paulo-SP) – Federal deputy Guilherme Castro Boulos was fined R$53,205 by judge Antônio Maria Patiño Zor, from the 1st Electoral Zone – Bela Vista, for irregularly disclosing registered research data. The decision also determined that posts made on the social networks Instagram and Facebook should be excluded, under penalty of a daily fine of R$10,000.

According to the resolution, data were used that were true in isolation and taken from a previously registered survey, however, the results were released irregularly, with results “fused together to form a stimulated ‘frankenstein’ survey, as well as the absence of indication of the formal requirement for a level of trust”, highlighted the judge.

Also according to the judge, the published result did not correspond to any of the spontaneous or stimulated research scenarios, the result of a cut between the first and second stimulated research, in addition to not mentioning the other candidates mentioned in the stimulated research. In view of this, he considered it characterized as dissemination of electoral research without prior registration, which violates arts. 33, § 3, of Law 9,504/97 and 17 of TSE Resolution No. 23,600/19.

In addition to the irregularity, the research failed to indicate the formal requirement for a level of trust, provided for in art. 33, “caput”, and item IV, of Law 9,504/97 and 10, “caput”, and item III, of TSE Resolution 23,600/19. The decision may be appealed.
