Brasilia DF) – The Minister of Justice and Public Security, Flávio Dino, defended, this Thursday (26), changes to the law on terrorism (Law 13,260/2016), to “broaden” the definition and classify criminal factions as terrorists, so that they are targets of more rigorous financial weakening mechanisms.

“When we talk about terrorism, we always remember global organizations linked to the geopolitical dispute over water, energy, territory, and which would even operate in Brazil. But we must also turn our attention to an aspect that, broadly speaking, I classify as terrorism. Dominating the territory, such as militias and factions that have established themselves in Rio de Janeiro, is or is it not, materially speaking, an act of terrorism?”

Dino questioned.

According to him, closing financing channels must be the center of the Brazilian strategy to overcome organized crime.

“This is the true path and not fictions like this of the infinite, fiscally unfeasible expansion of police contingents or even those creepy demagogies of going out shooting in the middle of the street, thinking that there are, in these weapons, silver bullets that will, by magic, , define the extirpation of organized crime, terrorism lato sensu from Brazil and ensure the peace that Brazilian citizens deserve”,

The minister participated in the congress on preventing money laundering and terrorist financing of the Brazilian Federation of Banks (Febraban).

According to Dino, the legislation treats terrorism as the act of causing social and widespread terror, alluding to the sabotage of means of transport, “which is what this faction of militiamen did [no Rio de Janeiro]set fire to buses and trains and prevented the movement of people and goods.”.

However, according to the minister, the current law requires that these acts derive from prejudice or discrimination based on race, color, ethnicity and religion. “And there is a closure of the scope of the norm”he explained.

The law on terrorism provides for a sentence of 15 years to 30 years in prison for

“anyone who receives, obtains, keeps, keeps in deposit, requests, invests or in any way contributes to the obtaining of an asset, good or financial resource, with the purpose of financing, in whole or in part, a person, group of people, association, entity , criminal organization whose main or secondary activity, even occasionally, is the commission of terrorism crimes”.

According to Dino, this year, the Federal Police (PF) has already blocked almost R$3 billion in assets from criminal organizations, identified in operations. Last year, the blockades amounted to R$350 million worth of assets linked to criminal practices.

In a single operation, according to the minister, approximately 200 high-end apartments in the most upscale areas of Brazil were blocked and which belonged to a criminal faction.

Dino explained that a national asset recovery network, Rede Recupera, is being created within the scope of the governance council of the National Strategy to Combat Corruption and Money Laundering (Enccla), made up of 90 organizations.

He also defended greater integration of intelligence teams from the PF, the Ministry of Justice and the civil police in the states. Dino mentioned that, in a recent integrated operation, police forces dismantled a gang that operated in 20 states and that handled R$500 million in one year, with the practice of money laundering and financial transfers through cryptocurrencies.

For the minister, in this integration it is necessary to have a special look at these aspects of money laundering, “so that the enormous financial power that these organizations boast is weakened”.

Enccla

The minister explained that at each cycle, Enccla prioritizes topics for action. In the current cycle that ends in November, with the council plenary, the focus was on virtual crimes, with emphasis on cryptoactives, and also environmental crimes, such as mining, deforestation and land grabbing.

In addition to Rede Recupera, Dino cited other effective Enccla actions, such as the training program; the network relating to laboratories on anti-money laundering technologies and the National Network of Judicial Police in Combating Corruption (Renaccor), which promotes integration and exchange of experiences between civil and federal police officers.
