Excess evidence increases pressure on Bolsonaro in actions at the TSE – 01/17/2023 – Bruno Boghossian

When it freed Jair Bolsonaro from a lawsuit for sending mass messages in the 2018 election, the TSE issued a warning. Minister Alexandre de Moraes said he knew the mechanism used to spread disinformation and warned that the court would impeach anyone who repeated that conduct in 2022. “We cannot create an ostrich precedent in any way. Everyone knows what happened”, he declared.

At that trial, TSE members recognized the campaign’s irregularities, but were unable to prove Bolsonaro’s direct participation in spreading false news. Without this connection, according to the ministers, there were not enough elements to revoke the mandate of the then president. The ostrich buried its head in the ground.

Bolsonaro should not have this zoological support in the new processes that threaten his political rights. The TSE “knows what happened” in 2022 and has a generous list of evidence of the former president’s direct participation in attacks on the electoral process.

The court took Bolsonaro’s fingerprints in a series of episodes over the past few years. He disclosed false suspicions about the electronic voting machines on the government TV station, repeated conspiracy theories to a group of diplomats, ordered the Ministry of Defense to lead an attack against the system and ordered his party to call on the TSE to annul part of the vote.

The actions calling for Bolsonaro’s ineligibility were reinforced with the inclusion of the draft that intended to establish exceptional measures to reverse the result of the polls. On Monday (16), the TSE included in one of these processes the document found in the house of its former Minister of Justice.

In the judgment on the 2018 campaign, Bolsonaro was unharmed due to lack of evidence and because the TSE recognized the high political cost of removing a president from office. The new lawsuits rely on excessive evidence and target a politician out of office.
