Entities ask the UN for help by vetoing the time frame – 10/03/2023 – Panel

This Tuesday (3), at least eight organizations will send an urgent appeal to UN special rapporteurs to intercede with the Lula (PT) government, recommending a full veto of the time frame project approved by the Senate last week.

The text was approved last Wednesday (27), almost a week after the STF (Supreme Federal Court) overturned the thesis.

The appeal is signed by Apib (Articulation of Indigenous Peoples of Brazil), Apoinme (Articulation of Indigenous Peoples and Organizations of the Northeast, Minas Gerais and Espírito Santo), Arns Commission, Conectas Human Rights, Cimi (Indigenist Missionary Council), Coiab (Coordination of the Indigenous Organizations of the Brazilian Amazon), Greenpeace and ISA (Instituto Socioambiental).

The request is addressed to the special rapporteur on the rights of indigenous peoples, José Francisco Cali Tzay, and the special rapporteur on the situation of human rights defenders, Mary Lawlor.

In the document, the entities state that the time frame project presents “a risk of serious violation of the human rights of Brazil’s indigenous peoples.” They also say that the text will allow the construction of roads, dams and works on indigenous lands without prior consultation and create rules that make it impossible to complete the demarcation process.

The organizations ask the Brazilian government, especially the ministries of Justice, Indigenous Peoples, the Environment and the Civil House, to recognize that the project approved by the Senate has “patent defects in constitutionality and conventionality” and that it constitutes “indisputable social setback”. Therefore, they request that they submit a full veto of the proposal.

Furthermore, it asks the UN special rapporteurs to issue a joint press release warning of the seriousness of the situation and “expressing the rapporteurs’ opinion on the incompatibility of this legislation with international human rights standards.”
