The Minister of Justice and Public Security, Flávio Dino, countered criticism of the project that will be taken to Congress to toughen penalties for crimes against the democratic rule of law. As he said this Saturday (22), the measure is necessary to target the “very dangerous Nazi-fascism of the 21st century”.

The Lula government (PT) will send two bills to the National Congress to toughen punishments in response to the January 8 coup attacks, almost six months after announcing a “democracy package”.

Among the penalties provided for are 20 to 40 years in prison for crimes that attempt against the lives of presidents of the three Powers, the vice president of the Republic, ministers of the STF (Federal Supreme Court) and the attorney general of the Republic, with the aim of altering the democratic constitutional order.

The sentence of up to 40 years became possible as of 2019, with the approval of the anti-crime package. Until then, the limit in Brazil was 30 years.

The bill also provides for a penalty of 6 to 12 years in prison for those who organize or lead anti-democratic movements and 8 to 20 years for those who finance them.

Dino said that perpetrators of crimes against the democratic order “should be firmly punished, given the harmful conduct.”

“For this reason, I support bills, judicial decisions or investigations by the Federal Police that are consistent with this attitude of combating the very dangerous Nazi-fascism of the 21st century, which kills children in schools, destroys the Supreme Court building and thinks it is authorized to attack people for political reasons”, he said.

The minister stated that he respects the criticism, but will maintain the same line of action. “Whoever minimized anti-democratic risks, 100 years ago in Germany or Italy, fed a monster. I try not to sin by omission. This is how true PEACE is built, the one that is born from RESPECT FOR THE CONSTITUTION”, he wrote on the social network.

In addition to the proposal that toughens penalties, the government also announced a bill that authorizes the seizure of assets and the blocking of bank accounts and financial assets in crimes against the democratic rule of law.

The project determines that this type of precautionary measure can be made ex officio by the judge, in addition to including the Union among the actors that can request it.

A decree on weapons, which creates more restrictions on access to weapons, also displeased part of the parliamentarians of the Chamber of Deputies.

The decree transfers to the Federal Police the responsibility for supervising the so-called CACs (hunters, shooters and collectors). Until then, this attribution was with the Army. The measure reverses the increasing flexibility observed throughout the administration of Jair Bolsonaro (PL).

A group of more than 50 deputies filed, this Saturday, a Project for a Legislative Decree that suspends the decree issued by the federal government. Authorship is by deputy Paulo Bilynskyj (PL-SP).
