Defense of suspects of harassing Moraes considers asking Italian Justice for images – 07/22/2023 – Politics

The defense of the family investigated on suspicion of hostility to the Minister of the STF (Supreme Federal Court) Alexandre de Moraes says that he is considering asking the Italian judicial authorities for the images of the Rome airport.

The Federal Police is still waiting for the videos from the terminal security cameras to investigate the conduct of Brazilians. According to police sources, Interpol has already received the material, but can only send it to Brazil after approval by the Italian Justice.

The defense says it fears not having immediate access to the material after it is made available to the Brazilian authorities. “It is fair that both parties receive the material, at the same time, being able to analyze it in its entirety”, says in a note the lawyer Ralph Tórtima Filho.

“We have already requested access to the images in the records that are being processed by the STF. We await a decision in this regard. It is very important that the so-called ‘parity of arms’ is respected, allowing the defense to also receive, with agility, a copy of the images provided by Italy.”

The minister reported that he was called a “bandit”, “communist” and “bought” by a group at the airport in Rome and that his son -lawyer Alexandre Barci de Moraes, 27- suffered an attack, causing his glasses to fall to the floor, on the 14th.

The police are investigating the couple Roberto Mantovani Filho and Andreia Munarão, who were also with Alex Zanata Bignotto, his son-in-law, and Giovanni Mantovani, his son.

In the departures area of ​​Rome’s international airport, those responsible for the hostilities approached and hurled abuse at the minister, according to investigators.

The family admits that there was what they call an “intervero”, but denies having harassed Moraes and claims that they only reacted to offenses received. Tórtima initially said that Mantovani “pulled away” the magistrate’s son with his arm, but, in an interview with UOL, he said it was not clear whether it could have been “a push or a slap”.

The defense also seeks to reinforce that there was no political motivation in the case, but a confusion with people who were not known to be connected to the minister, initiated by a matter related to entering the VIP lounge at the airport. The discussion would have started with Andeia and a woman and a man.

According to the lawyer, the video recorded by the family and delivered to the PF on Wednesday (19) shows the minister’s interaction at a time when he is trying to remove his son, who is outside the VIP room. Also according to the defense, the video was provided in full.

On Tuesday (18), businessman Roberto Mantovani Filho and his wife Andreia Munarão were the targets of a search and seizure order ordered by the President of the STF, Minister Rosa Weber.

Specialists heard by Folha consider that the action should be conducted in the first instance, not in the Supreme Court, because the suspected businessman and others involved do not have special jurisdiction.

The defense claims that there was disproportionate treatment given to the suspects.

Moraes participated in an international law forum held at the University of Siena in Italy. He was a member of the panel on Constitutional Justice and Democracy, in which minister André Ramos Tavares, also a member of the TSE (Superior Electoral Court), also participated.
