Defense had less than 24h to send defense from 1/8 – 05/09/2023 – Panel

Part of a group of 250 denounced for the attacks on the headquarters of the Three Powers on January 8 were denied the right to oral support in their defenses due to a period of less than 24 hours given by the STF (Federal Supreme Court) to the Public Defender of the Union.

This is what Gustavo de Almeida Ribeiro, a public defender of the Union who works at the STF and is part of the team that is receiving cases from those involved in 8/1, says.

The DPU was notified around 4:00 am on Monday (8) that it would have to present the defendants’ oral support by 11:59 pm on the same day.

As the trials have taken place in the virtual plenary, the arguments consist of videos sent by the system, with the presentation of defense arguments.

“We were summoned a few hours before the trial began. There are 250 in that group. Not all are sponsored by the Defender’s Office, but many are. although they are similar, they have to be made and sent individually. In addition, uploading the videos sometimes causes problems, it crashes”, says Ribeiro.

Minister Alexandre de Moraes voted to make the 250 defendants in the early hours of this Tuesday (9).

“Colleagues were unable to send everyone’s arguments. The body of the DPU is small. It is not mandatory to have oral arguments, but it is mandatory that the court sets a deadline. Oral arguments are important to draw attention to some aspects that the Public Defender’s Office considers relevant to the case. It is part of the broad right to defense”, he adds.

Ribeiro claims that the DPU will appeal to obtain the right to submit oral arguments that were not carried out to the ministers.
