Defendant of 8/1, who was wearing an ankle bracelet, dies after falling from a tree

Defendant in the 8/1 investigation investigating alleged intellectual authors of the anti-Lula demonstrations, Giovanni Carlos dos Santos, 46, died on Wednesday (24), after falling from a tree, in São José dos Campos (SP) .

Giovanni’s wake took place this Friday morning (26) and could be followed live on the Urbanizadora Municipal website.

Through social media, Giovanni’s lawyer, Valquíria Durões, invited friends and followers to attend the virtual wake, asked for prayers for the deceased’s family and, very emotional, said that, “today, Giovanni is definitely free”.

“It’s not been easy for me, much less for his father, for his family, but we count on the affection of each one of you. And may you pray for his father, pray for the family. I believe that God has already received him in heaven and, today, he is definitely free from all of this”, said the lawyer in a video published on her Instagram, this Friday (26).

Giovanni was on provisional release and remained monitored by an electronic ankle bracelet while awaiting trial. Giovanni was a defendant of the Federal Supreme Court (STF) in Inquiry 4,921, which investigates alleged intellectual authors of the demonstrations on January 8th. Those accused in this investigation may be charged with incitement to commit a crime and criminal association.

Although Giovanni’s death was caused by an accident, the case recalls the drama experienced by other 8/1 defendants.

One of them is the case of Rondônia journalist William Ferreira da Silva, 59 years old, who had his release permit signed by the STF minister, Alexandre de Moraes, this week, but cannot leave prison because he is admitted to the hospital with suspicions prostate cancer and other serious health problems. William was arrested without complaint.

Another notable case was the death of businessman Cleriston Pereira, who died on November 20, 2023 after suffering a sudden illness while sunbathing in Papuda, where he had been held in preventive custody for ten months on suspicion of involvement in the acts of the 8th. of January.

Due to comorbidities, Cleriston even received a favorable opinion from the Federal Public Ministry (MPF) for his release. The request for provisional release was sent to Moraes at the end of August 2023 and was awaiting analysis by the minister.

The minister also ignored several medical warnings about the prisoner’s risk of sudden illness if he did not receive adequate treatment.
