Daniel Alves is expected to testify in the first session, on February 5th, together with six witnesses
The case of Daniel Alves, accused of raping a woman inside a nightclub in Barcelona, had his trial confirmed this Monday (29), by the Barcelona Audience.
According to the highest instance of local justice, the trial will take place between February 5th and 7th, in a Barcelona court. The sessions are expected to last three days.
In total, in addition to the former player, 28 witnesses who were at the scene on December 30, 2022, will give testimony. The request was made by both parties: defense and prosecution.
Daniel Alves is expected to testify in the first session, on February 5th, together with six witnesses. The remaining 22 will participate on the 6th. Finally, on February 7th, the expert procedures will deliver reports and conclusions on the case.
Given this, Isabel Delgado Pérez, the judge responsible for the case, will prepare the final sentence, which has nothing to be disclosed, according to G1. Even so, Daniel Alves will remain in pre-trial detention until the decision is announced.
While the Spanish Public Prosecutor’s Office is asking for nine years in prison, the victim’s defense demands a 12-year sentence. The woman, in fact, should not go to trial, as determined by the Court to preserve her identity.
Remember the Daniel Alves case
Arrested since January 20, 2023, in Barcelona, accused of a sexual crime, Daniel Alves is close to his trial. The 40-year-old Brazilian was detained while giving a statement about the case of sexual assault against a woman in the early hours of December 30, 2022.
The Public Prosecutor’s Office requested the athlete’s preventive detention, without the right to bail, and the head of Instructional Court 15 in Barcelona accepted the request, ordering his detention.
Daniel Alves is accused of sexually abusing a woman at the Sutton nightclub, in Barcelona, Spain. The athlete, who defended the Brazilian team at the World Cup in Qatar, allegedly locked, assaulted and raped the complainant in a bathroom in the club’s VIP area, according to the newspaper El Periódico. She looked for her friends and the club’s security guards after the incident.
The nightclub’s security team contacted the Catalan police (Mossos d’Esquadra), who took a statement from the victim. A camera worn on a police officer’s uniform accidentally recorded the victim’s first version of the case, corroborating what she said in the official statement.
The woman also underwent a medical examination at a hospital. Daniel Alves left the scene before the police arrived.
In recent months, the Spanish Court has denied all of the Brazilian’s requests to respond to the case in freedom, on the grounds of an imminent risk of Daniel Alves fleeing to Brazil.
