CPI of 8/1 studies activating CNJ against Kassio Nunes Marques – 09/12/2023 – Mônica Bergamo

The CPI leadership on January 8 is considering filing a representation with the CNJ (National Council of Justice) against minister Kassio Nunes Marques, of the STF (Supreme Federal Court).
The articulation occurs after the magistrate granted a habeas corpus to delegate Marília Ferreira de Alencar, former director of Intelligence at the Ministry of Justice, and shielded her from a hearing that would be held by the commission this Tuesday (12).
The Supreme Court minister’s decision caused controversy among deputies and senators who are part of the commission’s command for allowing the investigated woman to miss her testimony. On other occasions, court magistrates allowed those summoned to remain silent, but not to be absent.
In the opinion of parliamentarians heard by the column, Nunes Marques’ decision represents an obstruction to the work of the CPI and a dangerous precedent, since any and all deponents could appeal to the STF to be free from providing clarifications.
The habeas corpus, granted in a monocratic and confidential decision, had the power to unite the members of the collegiate leadership on the left, center and right. The Senate’s lawyers have already appealed.
Right-hand woman of former minister Anderson Torres at the Ministry of Justice and the Security Secretariat of the Federal District, Marília Alencar was summoned by the CPI to provide explanations about the operations carried out by the PRF (Federal Highway Police) during the second round of the 2022 elections.
The delegate is appointed as responsible for a survey of the municipalities in which the then candidates Luiz Inácio Lula da Silva (PT) and Jair Bolsonaro (PL) had received the best votes in the first round of the election.
The suspicion is that the map was used to mount several PRF raids and make it difficult for PT voters to reach their polling places.
As the delegate did not attend, the CPI on January 8 heard this Tuesday military police officer Marcela Pinno, who was attacked during the coup attack against the headquarters of the Three Powers, in Brasília.
