Commission approves Malafaia’s replacement with rules for inter-federative action in disaster management – News of Brazil

The National Integration and Regional Development Commission of the Chamber of Deputies approved a bill that defines rules for interfederative cooperation in risk and disaster management actions and for the transfer of resources from the National Fund for Public Calamities, Protection and Civil Defense (Funcap). The approved text is a substitute presented by the deputy Dorinaldo Malafaia (PDT-AP) to Bill 698/22, by deputy Mário Heringer (PDT-MG), which specifically deals with public support for the receipt and distribution of donations and supplies to victims.
“The distribution of donations is a measure of emergency humanitarian assistance and, therefore, PL 698/22 is worthy. But I understand that our country needs interfederative cooperation for all disaster response actions”stated Dorinaldo Malafaia. “In other words, the Union, states and municipalities working together not only in the distribution of donations and supplies, but in all necessary measures to prevent or resolve an emergency situation.”
The substitute amends Law 12,340/10, which deals with transfers of resources from the Union to states and municipalities for prevention in areas at risk of disasters and for the recovery of affected regions.
Collaboration
The approved text establishes that the bodies and entities of the National Civil Protection and Defense System will be able to act in collaboration to carry out prevention, response and recovery actions in affected areas and also in the supervision and accountability of resources transferred.
Interfederative cooperation may occur, among other mechanisms, through the hiring of public consortia and the formation of councils with the participation of representatives from the states, the Federal District, municipalities and civil society.
The substitute makes it clear that, regardless of the registration of municipalities with risk areas in the national register, the Union and the states will support municipalities in carrying out actions such as mapping and construction implementation plans.
It also provides for the allocation of Funcap resources for prevention, response and recovery actions in areas affected by disasters, modifying the wording of the current law, so that actions are not restricted to emergency support.
The rapporteur defended faster release of Funcap resources. Therefore, the substitute frees federative entities from bureaucracies that delay the process.
Processing
The proposal is being processed conclusively and will still be analyzed by the Finance and Taxation and Constitution and Justice and Citizenship committees.
