CNJ investigates the judge’s speech about the North and Northeast – 04/18/2023 – Power

The national justice inspector, Luis Felipe Salomão, filed a complaint against judge Mário Helton Jorge, from the Court of Justice of Paraná, who said in a session on the 13th that the state “has a cultural level superior to that of the North and Northeast” and that it is a place that does not have the “political game of other states”.

The comment was made by the magistrate during the session of the 2nd Criminal Chamber of the court. In his speech, he says that people remember Operation Lava Jato, the petrolão and the monthly allowance when talking about the court, but that sometimes he can’t even sleep.

Salomão claims that the statement reached the CNJ (National Council of Justice) and was widely publicized in press reports, recorded on video.

According to the minister, the magistrate’s manifestation, outside of any context in which the case was being judged, may have prejudiced and xenophobic connotations, in justification for opening the disciplinary complaint.

In addition, he stated that the facts conveyed authorize the action of the internal affairs department to investigate the magistrate’s conduct.

“Apparently, there is no justification for prejudiced and xenophobic statements, without any relation to the case that was being tried, in addition to being translated into possible criticism related to other processes”, he said.

For the magistrate, there is a need to investigate whether, in the administrative sphere, the content of the judge’s statements constitutes conduct that blemishes the provisions of the Federal Constitution, the Organic Law of the National Judiciary (Loman) and the rules of the CNJ.

According to the minister, in principle, the conduct may point to a possible violation of Loman articles.

Among them, complying and enforcing, with independence, serenity and accuracy, the legal provisions and official acts and maintaining irreproachable conduct in public and private life.

In addition to expressing, by any means of communication, an opinion on a pending trial, yours or someone else’s, or a disparaging judgment on orders, votes or sentences issued by judicial bodies, with the exception of criticism in the records and in technical works or in the exercise of teaching .

As a substitute member of the Regional Electoral Court of Paraná, the judge rejected in January requests for searches and breaches of secrecy in the action to revoke the mandate of senator and former Lava Jato judge Sergio Moro (União-PR), presented by Fernando Giacobo, deputy of the PL.

In a note to the Panel, the magistrate said that he had no intention of making a prejudiced comparison and apologized.
