CGU will have access to investigations conducted by Moraes against Bolsonaro

This Friday (2), the minister of the Comptroller General of the Union (CGU), Vinícius Marques de Carvalho, said that he is awaiting access to all investigations conducted by the minister of the Federal Supreme Court (STF), Alexandre, next week. de Moraes, whose main target is former president Jair Bolsonaro (PL). The list includes controversial investigations into digital militias, the alleged use of the Federal Highway Police (PRF) during the 2022 elections, Saudi jewelry, January 8 and the “parallel Abin”. According to Carvalho, the Federal Police (PF) is preparing the material to forward to the CGU.

According to the minister, the objective of sharing is “to speed up investigations to hold officials responsible who may have participated in illicit activities related to all investigations”.

Asked about the “parallel Abin” investigations, Carvalho did not rule out that illegalities within the Agency may have already occurred during the Lula government. The minister also said that the CGU found no obstacles in investigating the alleged espionage scheme within Abin.

In another part of the interview, when talking about the leniency agreement signed with Odebrecht, Carvalho said that the R$2 billion fine remains in force.

“Until the day there is a (judicial) decision saying that these payments are suspended, it (Odebrecht) has to continue paying,” he stated.

On Thursday (1), Minister Dias Toffoli, of the Federal Supreme Court (STF), suspended payment of the fine of R$ 3.8 billion (the amount that still remains to be paid out of the total of 8.5 billion) imposed on construction company Odebrecht after the leniency agreement signed as part of the Operation Lava Jato investigations.

Also according to Toffoli, Odebrecht may request a reassessment of the terms of the leniency agreement from the Attorney General’s Office (PGR), the Comptroller General of the Union (CGU) and the Attorney General’s Office (AGU) “enabling them to correction of the illegalities and abuses identified, carried out by the authorities of the Justice system”.

However, according to the CGU minister, it is not up to the Comptroller to “review the Public Ministry’s agreement”.

“In our understanding, this needs to be evaluated. I have no way of assessing what was illegal in the MP’s agreement. The person who can assess what was illegal in the agreement is the MP himself or the Judiciary. The CGU has no role in reviewing decisions made by the Public Ministry,” stated Carvalho.
