CGU wants to reexamine dismissal of trans professor by federal institute – 02/02/2024 – Panel

The CGU (Comptroller General of the Union) sent this Wednesday (31) to the rector of the Federal Institute of Ceará a letter in which it informs that it has decided to re-examine the administrative disciplinary process that resulted in the dismissal of Êmy Virgínia Oliveira da Costa, the first professor trans of the institution.

The document, signed by the Inspector General of the Union, Ricardo Wagner de Araújo, states that, based on the analysis of the process at the body, “it was concluded that there was a need to verify its regularity and adequacy of the penalty applied”.

According to the institute’s ordinance, Êmy was fired for habitual non-attendance. The justification is that the teacher was unjustifiably absent from her activities for more than 60 days in a period of 12 months without legal protection.

She states that she left to pursue a doctorate in Uruguay, that the institution was notified and that she never stopped fulfilling her workload. “I agreed with the students that I would bring classes forward,” she says. “All advance forms for this period are in the process, with the students’ signatures.”

According to her, the law says that there is only habitual non-attendance when there is no just cause. “I didn’t take time off to go for a walk, I didn’t take time off to do anything, I took time off to study the doctorate subjects. My enrollment is included in the process, the subjects and performance are included in the process.”

The teacher also says that she was fired for veiled transphobia. “I am the first trans professor, my presence is uncomfortable in one way or another. I was on an extremely sexist, misogynist, LGBTphobic campus”, she adds.

Êmy claims to have analyzed teacher dismissals from 2018 to 2023. Of the 12 dismissed during the period, nine were due to corruption. Of the other three, one was for physical aggression within the institute, one because he “completely disappeared” and the third for “serious insubordination.” “And there has never been a dismissal in a case similar to mine, right? That’s why we’ve been talking about veiled transphobia.”

In the note in which it commented on the professor’s dismissal, the rectory states that the institute is “an institution that embraces diversity, respects differences and treats its community in an equal and respectful manner, with the issue of inclusion and diversity as a policy, with established centers, programs and projects in the area, which are covered by Teaching, Research and Extension.”

“Finally, IFCE reinforces that administrative processes at the institution occur impartially, ensuring equality, without prejudice based on origin, ethnicity, gender, color, age and any other forms of discrimination, and reaffirms its commitment to combating and confronting any type of harassment and violation of diversity”, he adds.
