Dino wants to ban “vivandeiras” camps near barracks

The former Minister of Justice, Flávio Dino, who resumed his mandate as senator before being sworn into the Federal Supreme Court (STF), presented this Friday (2) the first bill in the legislature that he did not assume in 2023, when he was called by President Luiz Inácio Lula da Silva (PT) to form the government.

The project prohibits the setting up of camps near barracks like those that occurred after the 2022 presidential election and which culminated in the acts of January 8, 2023. Dino stated that the objective of the project is to avoid similar popular demonstrations — which has already is being considered unconstitutional by the opposition.

“I remember an expression coined by Marshal Castelo Branco, the first dictator of the Military Dictatorship, in which he criticized the so-called ‘barracks vivandeiras’, who, in his view, were civilians who went to the barracks doors to provoke the military into carrying out coups d’état. So, the first project is ‘anti-barrack villagers, to prevent camps outside the barracks”, he told journalists after Ricardo Lewandowski took office.

The text modifies law 3,437/1941 responsible for “prevention and repression against crimes that violate the Democratic Rule of Law and its institutions”, and suggests changes in the radius of restrictions around the barracks. Currently, the legislation establishes a limit of 1,320 meters and determines that “any construction or reconstruction in progress, or already authorized, will be suspended, to comply with the provisions of the previous letter” (see in full).

The justification highlights the camps that led to the acts of January 8, 2023 in the vicinity of military organizations, highlighting the “need” for adjustments to the legal system to prevent gatherings that could “culminate in acts that undermine the Democratic Rule of Law”.

“Such gatherings constitute a danger to the safety of military organizations and their members, exposed to various threats and risks, such as bomb attacks or the perpetration of other crimes”, states the text to which the People’s Gazette had access.

If approved, the PL establishes that at 1,320 meters from military fortifications, specific protocols will be observed, established by the Executive Branch through Decree, guaranteeing proportionality.

Flávio Dino also announced that he will present bills regarding preventive detention and custody hearings and for the allocation of the National Public Security Fund (FNSP) to recognize the merit of police officers.

“Today, the FNSP can only be applied to awards for people who provide information aimed at elucidating crimes. And I will propose that the fund can also create a system of recognition of merit, of merit, for police officers who carry out special acts, such as those that save lives, firefighters, serious fires, the one in Brumadinho”, he explained and gave an example.

Dino stated that two others should be presented, but did not mention them in an interview with journalists.

Exonerated from his position as Minister of Justice this Thursday (1st), Flávio Dino resumed his mandate as senator before taking office at the Federal Supreme Court on February 22nd.
