Responsible for the vote in the TSE (Superior Electoral Court) that should be decisive this Friday (30) to form a majority for the ineligibility of former president Jair Bolsonaro (PL), Minister Cármen Lúcia has in her recent history decisive votes against the former -Judge Sergio Moro and in favor of President Lula and federal deputy Aécio Neves (PSDB).

If convicted, Bolsonaro will be able to run again in 2030, aged 75, thus staying away from three elections until then (one of them being the 2026 national).

In the judgment of the TSE, the score is 3 to 1 against the former president, depending on just one more vote for the formation of a majority due to ineligibility. There are still 3 other members of the court to vote, in that order: Cármen, Kassio Nunes Marques and Alexandre de Moraes.

The TSE session was interrupted and will resume this Friday (30), from 12h.

In March 2021, precisely because of the change in Carmen’s vote, the STF concluded that Moro was partial in conducting the Lava Jato process that led to Lula’s conviction for passive corruption and money laundering in the case of the Guarujá triplex (SP). ).

On the occasion, by 3 votes to 2, the Second Panel of the Supreme Court upheld the habeas corpus in which the PT’s defense asked for the declaration of Moro’s suspicion and decided to annul the triplex’s action – all acts of the former judge are null and void.

Before that, in October 2017, she had to break the tie in the vote that ended up saving the mandate of then Senator Aécio Neves (PSDB-MG), suspected of receiving bribes from JBS —which he denies. She voted in the sense that, for the Supreme to remove a parliamentarian from office, the approval of the Legislature is needed.

This Thursday (29), at the TSE session that judges Bolsonaro, the minister came out in defense of the rapporteur of the action, Minister Benedito Gonçalves.

Cármen interrupted minister Raul Araújo, who was reading a vote against Bolsonaro’s ineligibility and saying there was no connection between the action and the draft of the coup found by the Federal Police in the house of former minister Anderson Torres.

The PDT action focuses on the meeting in July last year with foreign ambassadors at the Alvorada Palace. At the time, less than three months before the election, Bolsonaro made false and distorted statements about the electoral process, claiming to be based on official data, in addition to seeking to discredit TSE ministers.

“It didn’t seem to me that the reporting minister’s vote had any reference, neither authorship nor responsibility, of the first investigated [com a minuta golpista]”, said Carmen.
