Cardozo files English lawsuit over Mariana disaster – 05/24/2023 – Panel

Former Minister of Justice, José Eduardo Cardozo, was hired to defend the victims of the Rio Doce tragedy, in Mariana (MG), in a lawsuit filed in court in England.

This Wednesday (24th), he met with 28 mayors of municipalities affected by the dam failure to discuss the next steps in the action against BHP filed by the Pogust Goodhead office. Cardozo defends that local managers be heard in the renegotiation.

“As incredible as it may seem, until today, the municipalities have not been properly heard in the negotiations”, says the lawyer. “This is inadmissible. Municipalities cannot be treated as second-class federative entities”, he says.

According to him, the entry of the Luiz Inácio Lula da Silva government, which was elected committed to social and environmental issues, and the process in London offer a new opportunity for mayors to be heard. “Only in this way will fair and due compensation be able to reach all those affected and those who really need it the most.”

The Pogust Goodhead office filed the lawsuit, one of the largest in English legal history, in 2020 in England, where BHP has one of its headquarters. Initially, it represented 200 victims; today the number is over 700.

BHP has said that the lawsuit filed in England is unnecessary as it duplicates issues already covered by the Renova Foundation’s ongoing remedial work and the subject of ongoing legal proceedings in Brazil.
