In the first version of his statement and also in a video sent to a Spanish TV channel on January 5, the Brazilian said he did not know who the woman who accused him was.

Last Friday, summoned to testify about the case, Daniel Alves changed his version twice more. He said he actually had sex with the woman, but in a consensual way. The player’s defense admits that he changed the version.

The contradictions in the Brazilian’s testimony, in addition to the risk of flight due to a ticket already purchased to return to Mexico on Friday, the blunt and non-contradictory testimony of the woman who accuses him, as well as medical examinations and police information, made Judge Maria Concepción Canton Martín decree provisional arrest without bail.

The woman who accuses Daniel Alves of rape claims to have been locked in the bathroom. According to the statement, the player sat on the toilet, climbed her dress and forced her to have sex with him. The athlete would also have thrown her to the ground and forced her to perform oral sex on him. The woman would have tried to resist and therefore would have been assaulted. Then, Daniel Alves would have penetrated her by force before both left the booth.

There are no cameras in the bathroom. The images only show the entry of the two at different times and then the exits — hers first. The woman looks for a group of friends who were also at the club and the complaint is made on the spot. Security guards are still looking for Daniel Alves, but he had already left the club. The woman then goes for tests at a nearby hospital. According to the Spanish press, the examination would have found injuries characteristic of a rape.

Daniel Alves even gave three different versions of what would have happened at the club on December 30:

  • Before the judge, the Brazilian said he was in the bathroom when the woman entered and that there was no sexual intercourse.
  • To the prosecutor, he stated that he did not know what to do and that he stood still when she entered the bathroom.
  • Afterwards, he would have responded to the accusation claiming that the young woman jumped on him, performed oral sex on him and that he did not say anything before to “protect her”.

Despite the changes, Dani Alves denied that he sexually assaulted the woman in all statements. The complainant, in turn, remained firm and ratified the initial version.

A staff made up of two businessmen and a lawyer traveled from Brazil to Barcelona on Friday to provide legal, bureaucratic and emotional support to the player, who testified alone.

The crime allegedly took place on December 30, 2022 in Barcelona.

The Brazilian will be arrested until the investigation is finished, which can last up to four years. He underwent a medical and psychological examination before being sent to his cell.

The Justice continues to investigate what happened, taking testimony from witnesses, carrying out the expertise of the place and evaluating the medical examinations. He faces up to 12 years in prison.
