Cade’s Economic Studies Directorate recommended the cancellation of legal provisions that oblige companies to disclose salaries paid to men and women.

The determination follows a decree from the Ministry of Labor and Employment that aims to encourage salary equity.

However, the board sees the risk that this disclosure will expose the companies’ remuneration policy, opening space for collusion between companies and even the formation of a cartel.

Companies and class entities have already gone to the Supreme Court, questioning the constitutionality of this specific point of the law.

At the request of Cade’s president, Alexandre Cordeiro de Macedo, DEE prepared a study and made recommendations to the ministry.

If the cancellation of this measure is not maintained, the body recommends that the ministry create mechanisms to prevent “this information from becoming an instrument that facilitates collusive behavior, which may cause damage to free competition and, also, negative effects on the market itself.” work”.
