Brazilian clubs could be suspended from Conmebol tournaments, says FIFA – News of Brazil

This Sunday (25), FIFA and Conmebol sent a letter to the CBF (Brazilian Football Confederation) about the situation involving the removal of Ednaldo Rodrigues from the presidency and announced that they will come to Brazil in the week of January 8th to follow the process of the new elections.
In the text, football’s highest entity cites an article from the FIFA Statute: “FIFA member associations must manage their affairs independently and without undue influence from any type of third party”.
The issue raised is the involvement of José Perdiz de Jesus, president of the Superior Court of Sports Justice, who gave the CBF a period of 30 working days to hold new elections, in addition to the request for an interim CBF Board of Directors. FIFA classified him as an “intervenor”.
The letter highlights the possible punishments: “Any violation of such obligation may lead to sanctions as provided for in the FIFA Statutes, including suspension, and this even if the influence of third parties was/is not the fault of the member association in question (cf. art. 14, paragraph 3 of the FIFA Statutes)”.
FIFA and Conmebol will send a joint mission the week of January 8th next year to assess the situation and “work together to find a solution to the current situation”. In the text, the entities reinforce that no decision affecting the CBF, including calling elections, should be taken until the mission is carried out, which could also include a suspension.
If the CBF is suspended by FIFA, “it would lose all its membership rights with immediate effect and until the suspension is lifted by FIFA. This would also mean that the CBF, representative teams and clubs would no longer have the right to participate in any international competition or competition while it is suspended.”
Ednaldo Pereira Rodrigues was removed from the CBF presidency on December 7th.
STF minister denies overturning decision that removed Ednaldo
Minister André Mendonça, of the Federal Supreme Court (STF), denied on Friday (22) a request to suspend the effects of the decision of the Rio de Janeiro Court that removed the president of the Brazilian Football Confederation (CBF) from office, Ednaldo Rodrigues.
Mendonça understood that there are, at the moment, no minimum requirements that justify a preliminary (provisional) decision. The action was presented to the Supreme Court by the PSD on Monday (18).
When calling the Supreme Court, the PSD said that the decision of the Rio Court put at “concrete risk the organization of football in the country and its entire economic chain”.
The acronym argues that there is a risk that FIFA, football’s highest governing body, will apply sanctions to the CBF, stating that this could have a “disastrous effect” on Brazilian professional football, preventing the participation of national teams and clubs in championships.

On December 7, the Rio Court of Justice (TJ-RJ) decided to remove the president of the CBF, Ednaldo Rodrigues, from office and ordered the Brazilian confederation to call new elections within 30 working days. He also appointed the president of the Superior Court of Sports Justice (STJD), José Perdiz de Jesus, to temporarily lead the entity for the period.
The process has existed since 2018, on the initiative of the Public Ministry of Rio de Janeiro, still referring to the election of Rogério Caboclo, Ednaldo’s predecessor. The MP questions the confederation’s statute as being in disagreement with the Pelé Law because it provides different weights for clubs in voting to choose presidents.
The directors of the 27 federations had a weight of 3 in the vote, against a weight of 2 of the 20 clubs in Series A and a weight of 1 of the 20 in B.
In 2021, the court annulled the election of Rogério Caboclo and ordered an intervention in the CBF, naming Rodolfo Landim, president of Flamengo, and Reinaldo Carneiro Bastos, president of the São Paulo Football Federation (FPF), as the interveners. This decision was revoked shortly afterwards.

Based on the information provided to us so far, it appears that the president of the Superior Court of Sports Justice, Mr. José Perdiz de Jesus, as intervenor, insists on maintaining the elections within 30 working days and also requested the Court of Justice of the State of Rio de Janeiro the appointment of an interim Board of Directors of the CBF to take care of its business.
In this context, we would like to emphasize again that according to art. 14 pair. 1 i) and art. 19 of the FIFA Statutes, FIFA member associations must manage their affairs independently and without undue influence from any type of third party. Any breach of such obligation may lead to sanctions as provided for in the FIFA Statutes, including suspension, and this even if the influence of third parties was/is not the fault of the member association in question (cf. art. 14, paragraph 3 of the FIFA Statutes ).
As previously informed to CBF, FIFA and CONMEBOL will send a joint mission to Brazil during the week of January 8, 2024 to meet with respective stakeholders to examine the current situation and work together to find a solution to the current situation, in due respect for the applicable regulatory framework of the CBF and its autonomy.
FIFA and CONMEBOL would like to strongly emphasize that until such a mission is carried out, no decisions affecting the CBF, including any election or calling for elections, will be taken. If this is not respected, FIFA will have no option but to refer the matter to its relevant decision-making body for consideration and decision, which may also include a suspension.
In this regard, as a matter of order, we would also like to highlight that, should the CBF be eventually suspended by the relevant FIFA body, it would lose all its membership rights with immediate effect and until the suspension is lifted by FIFA. This would also mean that the CBF, representative teams and clubs would no longer have the right to participate in any international competition or competition while it is suspended.
