Bolsonaro wants the STF plenary to judge Moraes – 02/27/2024 – Mônica Bergamo

The defense of Jair Bolsonaro (PL) presented this Tuesday (27) an appeal to the decision of the president of the STF (Supreme Federal Court), Luís Roberto Barroso, who rejected removing minister Alexandre de Moraes from reporting on investigations related to undemocratic acts .

Lawyers claim that Moraes is positioning himself as a victim and, simultaneously, as a judge in investigations linked to Operation Tempus Veritatis, launched by the Federal Police this month.

According to messages obtained by investigators, Bolsonaro was involved in issuing a draft decree that provided for the arrest of Moraes and the annulment of the 2022 presidential election. The investigation also shows that the minister was monitored by the group that planned the coup plot.

Last week, the president of the Supreme Court rejected 192 requests presented by defendants and the former president who asked for Moraes to be suspected or prevented from reporting criminal actions.

Barroso concluded that “the direct interest in the action on the part of the allegedly prevented minister” was not demonstrated in a clear, objective and specific way. “For this purpose, generic and subjective allegations, devoid of legal basis, are not sufficient,” said the judge.

Bolsonaro’s defense now asks that the demand be analyzed by the STF plenary.

“The fact that the reporting minister sees himself as a direct victim of the acts investigated clearly creates the risk of bias in the processing and judgment of the incident”, state the former president’s lawyers in the appeal presented.

“The notorious legal knowledge of the IL cannot be ignored and could not be ignored. [ilustre] minister Alexandre de Moraes, being an academically qualified and experienced jurist, however, it is inescapable that, like every human being, he can be influenced within himself, compromising the impartiality necessary to carry out his functions”, they continue.

The appeal requesting that the case be taken to the plenary is signed by lawyers Paulo Amador da Cunha Bueno, Fabio Wajngarten, Daniel Bettamio Tesser, Saulo Lopes Segall, Thais De Vasconcelos Guimarães and Clayton Edson Soares.

The former president’s defense states that “the narrative of the alleged attacks and threats” shows that the accusations “transcend the institutional sphere” and affect “directly the person of the minister” Alexandre de Moraes.

Lawyers cite the case of retired colonel Marcelo Camara, a former Bolsonaro advisor who was targeted by the PF and has been in prison since February 8, as proof that the reporting minister puts himself in the role of victim.

They claim that Moraes justified Camara’s arrest by pointing out that the military had monitored his schedule of appointments and locations and that the continuation of these acts should be avoided.

“A context that makes its objective and subjective impartiality in deciding in these cases evident and strongly questioned”, they state.
