Bolsonaro criticizes the return of DPVAT charges, which he extinguished in 2020

Former president Jair Bolsonaro (PL) criticized this Wednesday (10) the approval by the Chamber of Deputies of a bill that recreates the DPVAT, the mandatory insurance to protect victims of traffic accidents. The project was authored by the government of President Luiz Inácio Lula da Silva (PT) and now goes to the Senate for analysis.
The DPVAT was extinguished by Bolsonaro in 2020 following a recommendation from the Federal Audit Court (TCU), with the aim of preventing fraud and mitigating the costs of supervision and insurance regulation by the public sector. The benefit was valid until December 31, 2019, but coverage was extended until 2025.
Bolsonaro stated that he extinguished the DPVAT “due to excessive collection and reporting of embezzlement”, and that “regrettably” Lula approved the return of the charge.
“Yesterday (Tuesday, 9), regrettably, Lula approved a project of his own for the return of the DPVAT, with another name: SPVAT (Mandatory Insurance for the Protection of Victims of Traffic Accidents)”, he said in a message on social media (see in full).
The new DPVAT approved by the Chamber also includes in the Brazilian Traffic Code (CTB), according to the rapporteur’s substitute, deputy Carlos Zarattini (PT-SP), a penalty equivalent to a fine for a serious infraction in the case of non-payment of mandatory insurance, with the payment required for annual licensing, transfer of the vehicle or its withdrawal from traffic authorities.
The project also provides for reimbursement of expenses for medical and supplementary assistance, including physiotherapy, medicines, orthopedic equipment, orthoses, prosthetics and other therapeutic measures, as long as they are not available in the SUS in the municipality where the accident victim resides.
Zarattini also included coverage for funeral services and professional rehabilitation for accident victims who were left partially disabled. It will be up to the National Private Insurance Council (CNSP) to establish the limits of amounts to be compensated and which expenses will be reimbursed.
