Lawyers for the former president under investigation claim that the minister cannot be interested in the case and the judge

The defense of former president Jair Bolsonaro asked that Minister Alexandre de Moraes, of the Federal Supreme Court (STF), be removed from reporting on the investigations that investigate the existence of a criminal organization that allegedly acted in an attempted coup d’état and abolition of the Democratic state.

In a petition filed this Wednesday (14), the defense argued that Moraes cannot be interested and at the same time a judge in the case. This is because the minister appears in the investigations as a target of the alleged scammers.

In parallel, the lawyers also asked for the return of Bolsonaro’s passport, seized as part of Operation Tempus Veritatis, authorized by Moraes. The former president is one of the targets and was banned from leaving the country or communicating with the others under investigation.

In total, 48 precautionary measures were taken against several people under investigation, including Bolsonaro’s former direct advisors and active and retired military personnel.

Bolsonaro’s defense maintains that the PF itself, in a petition, “undoubtedly” attested that Moraes would be a central victim of the acts being investigated, with the investigators “highlighting several action plans that directly targeted him”.

According to the lawyers, Moraes had ordered precautionary measures against people who allegedly inflicted personal fear on him, “in other words, he assumed, at the same time, the role of victim and judge”, says the defense statement.

The request was directed to the President of the Supreme Court, Minister Luís Roberto Barroso, and is signed by seven lawyers, including criminalist Paulo Cunha Bueno, and Fabio Wajngarten, former chief minister of the Presidency’s Communication Secretariat, who later became represent the former president.

In a report sent to the Supreme Court, the PF reports having collected evidence that Bolsonaro received and requested changes to a draft decree to carry out a coup d’état. The document, according to the police report, provided for intervention in the Electoral Court and the arrest of Moraes.
