Federal deputy Saullo Vianna filed bill no. 897/2024, which provides for mandatory authentication of all digital media generated or modified by Artificial Intelligence (AI) systems, with a clear and visible marking that indicates its origin and authenticity, guaranteeing the transparency and veracity of the information conveyed.

The measure covers any information, image, video, audio, document or content produced, disseminated or shared in a digital environment, including social networks, messaging platforms, websites, blogs, applications and other means of electronic communication.

“We defend this project to minimize the risks that this advanced technology can generate. Among the concerns are the violation of privacy, the spread of prejudices and the social risk of spreading false information or that leads to misleading distortions of facts”, explained Saullo Vianna.

Criminalization of deepfakes

Another proposal by Saullo Vianna, Bill 896/2024, aims to criminalize the creation and dissemination of deepfakes with the aim of defaming, deceiving or harming people.

Deepfakes are any audiovisual content manipulated or artificially created using digital technologies that represent real people in fictitious, misleading or defamatory situations.

The penalties for the crimes provided for in this law include payment of a fine, the value of which will be established according to the seriousness of the crime, and holds responsible the digital platforms that broadcast digital media generated or modified by AI, which will be responsible for implementing mechanisms that ensure the veracity and authenticity of these media.

The idea is to deepen the debate about AI and improve what already exists in terms of legislation on the subject.

“Our proposal establishes rules for the use of AI, but it is worth highlighting that we have to involve society and experts in discussions, protecting society, but without delaying technological development,” he added.
