Author of attack on daycare center in SC is sentenced to 329 years in prison

The man who killed three children and two teachers in an attack on a daycare center in Saudades, in western Santa Catarina, on May 4, 2021, was sentenced to 329 years and four months in prison in an initially closed regime. The case is still subject to appeal. The trial began on the morning of Wednesday (9) and the sentence was handed down on Thursday (10).

Because it is a felony crime against life, a popular jury was set up to analyze the case. Fabiano Kipper Mai, who was 18 at the time, has been in pretrial detention since the date of the crime.

During the attack, the man killed two employees at the day care center: teacher Keli Adriane Aniecevski, 30, and education agent Mirla Amanda Renner Costa, 20. Three other children under the age of two also died. A fourth child was critically injured but survived. Victims were attacked with dagger blows, a kind of sword.

He was accused by the Public Prosecutor’s Office of five triple qualified homicides for base reasons, cruel means and use of resources that made it difficult for the victims to defend themselves; 13 double-qualified attempted homicides for base and somewhat cruel motives; and an attempted homicide qualified by base motive, cruel means and use of resources that made it difficult for the victims to defend themselves.

The author of the crimes will still have to pay R$500,000 to each family of the dead victims, R$400,000 to the surviving baby’s relatives and R$40,000 to each victim of attempted murder, according to the newspaper. Folha de S. Paulo.

The defense argued that the defendant suffers from paranoid schizophrenia, which would make him unable to understand the seriousness of the acts he was committing. The defense technical assistant claimed that the man would have refused to take the medicine indicated by the doctors because he did not recognize himself as a patient. The psychiatrist in charge also alleged that the defendant has a distorted understanding of reality. According to the defense, he was bullied at school.

On the other hand, the prosecution understood that the man suffers from mild mental deficiency and personality disorder, illnesses that do not make him unaccountable. Having planned the attack for months, the prosecution’s technical assistant understood that there was “method and intention”.

The accused’s internet history and research was also included by the Public Prosecutor’s Office as proof of planning the attack. The agency claimed that searches were found on bomb manufacturing, accused of attacks on schools and purchase of firearms.
