Responding to a petition filed by the Public Ministry of Amapá (MP-AP), the judge Carlos Torkfrom the state Court of Justice, promoted the lifting of the restricted access to the records of the Operation Marked Letters, held over two days within the Mazagão City Hall. The MP justified the request by stating that all search and seizure warrants were fulfilled, and there was no longer any need to maintain the imposed secrecy, so that the parties could have broad access to what had been done.

On April 2 and 3, a task force involving the Amapá Public Ministry, intelligence forces and police carried out 82 search and seizure warrants issued by the Amapá Court of Justice, in the states of Amapá (Mazagão, Macapá and Santana), Pará (Belém and Ananindeua) and Bahia (Salvador). Operation “Cartas Marcadas” investigates crimes of active and passive corruption, bid fraud, money laundering and formation of a criminal organization, committed between 2020 and 2023, in the city hall of Mazagão.

The Special Action Group for Combating Organized Crime (GAECO) and the Investigations Center (NIMP) were directly involved in the operation, by delegation from the Attorney General’s Office, with support from the Military Office and members of the Federal Police (PF ), Federal Highway Police (PRF), Military Police (PM) and Civil Police (PC) in the state of Amapá. There were more than 350 men and women involved in the operation, all from the Amapá security forces.

According to the investigations, the criminal actions resulted in fraud in around 100 bidding processes and their respective contracts, whose services to be provided would amount to more than R$150 million. According to the analysis of the MP-AP Anti-Money Laundering Technology Laboratory, between 2020 and 2023, those investigated moved around R$200 million in their bank accounts.

The investigations also pointed out the direct involvement of the mayor of Mazagão, João da Silva Costa, known as Dudão, who was not only aware of the misuse of the municipality’s money, but also himself, some family members and friends invested in positions of trust, enjoyed movable and immovable assets acquired with diverted public resources.

The Public Prosecutor’s Office represented, for the purposes of criminal investigation, the issuance of a search and seizure warrant against the following individuals and legal entities:

Also in the case are Mazagão City Hall and the municipal departments of: Finance, Administration, Education, Infrastructure, Health, Social Development, the Social Security Institutes, Environment, Economic and Rural Development; the Permanent Bidding Committee of the city hall and the Permanent Bidding Committee of the Department of Education.

According to the MP, the representation is based on the investigation initiated through the Attorney General’s Office, following the approval, by the Court of Justice, of the request for authorization to initiate an investigation, when it was opened, in 2022, in the extrajudicial scope of the PGJ the criminal investigative procedure with the aim of investigating possible corruption schemes in bidding processes within the municipality of Mazagão, involving the mayor, João da Silva Costa, municipal secretaries and businesspeople, in an alleged characterization of a criminal organization.

The complex of investigations called “Operação Cartas Marcadas” identified the existence of a corruption scheme involving public agents, bidding fraud and suspicions of money laundering within the city hall. Those investigated are part of a branch of the criminal organization led by the mayor of Mazagão João da Silva Costa, known as Dudão, who is serving his second term.
