The commander of the Army, General Tomás Paiva, has told authorities in Brasilia that his orientation is for all the military involved in the January 8 acts, whether by intent or omission, to be punished.
The Force is conducting internal investigations, in addition to those that should occur in court. As Paiva has stated, the rule will be not to spare anyone.
He considers, however, that he also does not intend to make a fuss. The law itself determines the secrecy of investigations still in progress, precisely so as not to hasten the trial and expose anyone who eventually proves innocent.
General Tomás has sought authorities from other Powers in order to ease relations between the military and other institutions. A minister who was with him recently reports that the feeling was that the commander wants to make it clear that the time of hostilities is behind him.
In Justice, there is a scenario of uncertainty about actions involving military personnel, which may result in friction between the government of Luiz Inácio Lula da Silva (PT) and Minister Alexandre de Moraes, of the STF (Federal Supreme Court).
Rapporteur for investigations at the STF, Moraes has told people close to him that he intends to keep all cases in court, that is, in common law.
In the government, there was an initial assessment that the cases should remain in the Military Court, but Moraes’ contrary position led to a reassessment of the understanding.
