Aras is in a hurry to reappoint a vacant ally at the CNJ – 06/15/2023 – Frederico Vasconcelos

The Attorney General of the Republic, Augusto Aras, is in a hurry to confirm the reappointment of the prosecutor João Paulo Santos Schoucair, from Bahia, as counselor of the CNJ (National Council of Justice) in the vacancy destined for members of the MP of the States.

Schoucair’s current term does not end until the end of June 2024.

This Wednesday (14), the CNPG (National Council of Attorneys General of the Public Ministry of the States and the Union) voted on the triple list with the names chosen in the states.

Schoucair got 24 votes. Public prosecutor Rafael Schwez Kurkowski, from Sergipe, obtained 14 votes and public prosecutor Roberto Livianu, from São Paulo, 10 votes. The meeting was led by the President of the CNPG, Attorney General of Justice of Pará, César Mattar Jr.

According to the established norms, the three names indicated by the CNPG would have five days to send their resumes to the executive secretary of the agency. After proclaiming the result, the president of the CNPG would send the nominations to Aras, until the 22nd of June.

On the same day of the vote, however, Aras sent a letter to the president of the Senate, Rodrigo Pacheco, without registering that Schoucair already holds the position. In the message, he only mentions that the Bahian prosecutor was nominated “for the biennial composition” of the CNJ.

In the CNPG news, it is mistakenly stated that Schoucair was nominated “for composition of the CNJ in the 2023/2025 Biennium”.

Aras’ term ends in September. If he is not reappointed by President Lula, the anticipation of Schoucair’s nomination prevents the next PGR from choosing another name.

Schoucair is a countryman and ally of Aras. In the electoral campaign for the first term, he presented himself as coordinator of Gaeco of the MP of Bahia and auxiliary member of the PGR. He was one of the assistants of the PGR’s Criminal Legal Advisory at the Superior Court of Justice, then coordinated by the deputy attorney general Lindora Araújo, Aras’ right-hand man.

In 2020, Aras brought forward the choice of who would occupy the same chair by 14 months.

The term of counselor Ivana Farina Navarrete Pena, former Attorney General of Goiás, would end on October 22, 2021. In August 2020, Aras launched the selection process.

The anticipation was seen as a message to Ivana that she would not be reappointed because she belonged to the group of former attorney general Raquel Dodge, who had nominated her. She could run for a new term, but she didn’t sign up. Raquel and Ivana did not comment on the fact.

Ivana’s name was announced by Raquel in March 2019 and approved by the Senate six months later. She was the most voted in MP-GO and CNPG. She was the first woman to chair the CNPG.

On that occasion, Aras said that the deadlines were brought forward, in times of Covid-19, so as not to wait a year for the names to be considered in the Senate plenary. He cited as an example the CNMP, which had been short of three members for a year.

In a message he sent to the PGJs, Aras requested “starting the procedure for nomination”. He informed that he took the measure “in compliance with an official letter signed by the president of the CNJ” [Dias Toffoli].

Aras did not mention that Toffoli’s message was a response to a letter that he, Aras, had sent on August 19, reiterating the “request that the procedure for choosing the representative of the state Public Ministry to compose the CNJ be initiated”.

Toffoli responded to Aras’ query on 4 September. Four days before the end of his term as president of the CNJ.

The Secretariat for Social Communication of the Attorney General’s Office informs that the nomination is made in advance because it is a long process, which involves the Legislative Power, including a sabbatical in the Constitution and Justice Committee of the Senate and voting in the Plenary.
