The targets of the blockade of assets ordered by the Federal Court after the coup acts of January 8 complain of difficulties in paying for health care and receiving child support.

In one of the cases, there is even a complaint that a vehicle owned by an owner not involved in the acts ended up blocked by mistake.

The demonstrations are part of a process in which the AGU (Attorney General of the Union) requested the blocking of assets of suspects of financing bus charter to participate in coup acts. The objective is to guarantee compensation for the damages caused by the depredations to the public coffers.

The AGU filed a total of seven lawsuits —among them that of the alleged financiers of the buses— asking for the blocking of BRL 26.2 million. The targets are 250 people, three companies, an association and a union. The AGU makes the legal representation of the government.

This is the estimate of the damage caused to public property with the depredation of the buildings of the three Powers at the time of the coup attacks.

Individuals who had their assets blocked were not necessarily criminally charged for having participated in the depredations or instigated the January 8 acts. Justice has already ordered unlocking in some cases.

This month, the AGU had access to the criminal proceedings in progress at the STF (Federal Supreme Court), under the report of Justice Alexandre de Moraes. The body claims that it is analyzing the information to promote new actions with claims for damages.

People appointed by the AGU as funders of the acts have presented defense manifestations in the action that deals with suspects of chartering buses to go to the acts in Brasilia.

Part of the cases involve people asking for urgent release of goods to avoid further damage caused by restrictions.

In May, the defense of Sandra Nunes de Aquino, 51, asked for an urgent review of her case. The reason is that she had had surgery to remove a brain tumor.

“Until now, there is no certainty of malignancy, although there are indications”, says the defense. “[Ela está] recently operated, with more than 40 stitches on her head and without a real payment, without even being able to buy her medication”, she says.

“His salary account is still blocked, and his livelihood and daily maintenance is being carried out by charitable third parties, and this situation can no longer last”, says the lawyer Syndoiá Stein Fogaça.

There are also situations in which those who had assets blocked claim that they use the affected account to receive alimony money for their children.

In another case, a motorcycle dealer claims that he bought in October last year, before the elections, the motorcycle of Rieny Munhoz Marcula — one of those accused of participating in the demonstrations in Brasília.

He presented the purchase receipt in the process. However, as his bike was still in Rieny’s name, it ended up being blocked in the process.

The defense complains that so far he “cannot carry out the sale of the same [a moto] due to the restrictions inserted, bearing the same loss since it cannot transfer to third parties and it is stopped in stock”.

In general, the people who had their assets blocked claim that they had gone to Brasília for a peaceful demonstration, and that they were not responsible for financing the acts that destroyed the buildings of Congress, the STF and the Planalto Palace.

The defense of retired Aparecida Zanini said that the group that was on the bus would not necessarily participate in demonstrations, but would go on an excursion “in which some took the opportunity to get to know the federal capital”.

The pensioner said that she believed —still according to the defense— that January 8 was an event that “would be carried out in a calm and peaceful way”.

The contract with the bus company that went to Brasília was in the name of Aparecida, but the defense claims that this was a requirement of the ANTT (National Land Transport Agency); and that each of the passengers paid individually for the trip.

“[Aparecida] she was never a financier/sponsor of anything, and her pension of BRL 2,344, which is blocked, barely manages to sponsor herself”, says lawyer Gustavo Gottardi.

Sought, the AGU says it reconsiders requests when the suspect presents arguments and evidence. This is the case, for example, of a tourism company that ended up withdrawing from the final request for compensation of damages to the Union because it was considered only an intermediary for chartering buses.

According to the agency, the company proved the contracting and proof of payment for the service by former police officer Valfrido Chieppe Dias. Valfrido was arrested on January 23 by the Federal Police in the investigation of coup acts.

“Dias became part of the passive pole of the public civil action proposed by the AGU to the Federal Court, on March 3rd, with a request for compensation for collective moral damage due to the destruction of public property”, says the AGU.

“The fact that the company has been excluded from the action does not imply that it cannot be included again in the demand, if new elements prove its eventual participation in the mentioned events.”

In the action that asks for the definitive condemnation for the damages to the public coffers, the AGU affirms that the suspects of participating in the acts “were aware that the movement in organization could cause the event as it happened”.

It also states that the announcements already made “express reference to designs of non-peaceful acts (or of dubious peacefulness) and the seizure of power, a fact that demonstrates a prior articulation of the movement with a non-orderly purpose, with the financing of transport being a vector primordial for it to take shape and materialize in the terms that occurred”.
