8/1: STF forms a majority to make the clock vandal defendant – 06/26/2023 – Power

The STF (Federal Supreme Court) formed a majority this Monday (26) to make defendants over 45 involved in the coup attacks on January 8.

Among them is Antônio Cláudio Alves Ferreira, captured by the security cameras of the Palácio do Planalto destroying the historic clock brought to Brazil by Dom João 6º, in 1808.

Justices Alexandre de Moraes (rapporteur), Gilmar Mendes, Edson Fachin, Cármen Lúcia, Luiz Fux and Luís Roberto Barroso have already voted to open criminal actions.

In the case of Ferreira, Kassio Nunes Marques and André Marques, both nominated by Jair Bolsonaro (PL), voted for the recognition of the jurisdiction of the first instance of the Federal Court to judge the case and, on the merits, for the receipt of the complaint.

The report was unable to locate Ferreira’s defense, which failed to manifest itself even in the case file, according to information recorded by Moraes in his report.

With this further wave of complaints from the PGR (Attorney General of the Republic) analysed, the number of supporters of the former president who will be prosecuted by the court rises to 1,290, the majority under the accusation of inciting the Armed Forces against the Powers and of association criminal.

The analysis is carried out in the virtual plenary of the Supreme Court, with the insertion of votes in the electronic system of the court. The trial will conclude at 11:59 pm this Monday.

Although there are still 100 complaints from the Attorney General’s Office pending analysis, this week the STF began the hearing phase of 232 cases already filed, with testimonies from defense and prosecution witnesses, as well as interrogations of the defendants.

The hearings take place via videoconference and are held by four judges who act in support of Moraes. They must be completed by July 31st.

Priority was given to people who remain in prison and are accused of more serious crimes, such as
attempted violent abolition of the democratic rule of law, attempted coup d’état, qualified damage and deterioration of listed public property.
