102 people linked to 8/1 remain in prison, according to the STF

Almost 11 months after the events of January 8th at Praça dos Três Poderes, in Brasília, 102 people remain in prison, according to information from the Federal Supreme Court (STF), some with serious comorbidities, such as colonel Jorge Eduardo Naime. Of the total number of prisoners, 32 people were arrested during the acts in Brasília on January 8, and 70 had arrests ordered after that date through Operation Lesa Pátria of the Federal Police (PF).

According to information sent by the STF to Gazeta do Povo, 12 prisoners are being investigated for alleged “participation in groups of financiers”, 47 are considered “executors” of the actions, and 11 are said to be “instigators” of the acts.

Those who were arrested in the public buildings of Praça dos Três Poderes are accused of armed criminal association, violent abolition of the Democratic Rule of Law, coup d’état, qualified damage through violence and serious threat, with the use of flammable substances, and deterioration of listed property .

The crimes are the same for everyone involved, as the Attorney General’s Office (PGR) understood that there was a multitudinous crime, which is committed by crowds inflamed by hatred, even without the existence of evidence linking the defendants to acts of depredation .

“The allegation is that there was a psychological bond that motivated these people to commit the acts, so it makes no difference whether they vandalized, invaded, sought shelter or just stayed on the lawn”, explains the lawyer Tanieli Telles de Camargo.

Sequence of prison revocations, according to the STF

On January 8, according to the STF, they were arrested 243 people inside public buildings and in Praça dos Três Poderes, with 161 men and 82 women sent to the Papuda Penitentiary Complex and the Federal District Women’s Penitentiary, Colmeia.

The next day, January 9th, 1,927 people were taken to the National Police Academy by the Army and the Military Police (PM), where 775 were released and 1,152 remained trapped.

Between the 17th and 20th of January, after the custody hearings, another 214 people left the prisons, while 938 people remained incarcerated.

Favorable statements from the Attorney General’s Office (PGR) were analyzed by Minister Alexandre de Moraes in the months of February and March, and he granted 680 provisional freedoms during this period.

These people left prisons “through the imposition of various precautionary measures”, but the STF did not specify the number of people who still wear electronic ankle bracelets, a device that deprives individuals of leaving home at night and on weekends, makes work difficult and prevents including going to church.

Between the end of April and June, a new demonstration by the Public Ministry was in favor of the provisional release of prisoners from January 8th and also Operation Lesa Pátria. The minister complied with the requests, “remaining 283 people”, according to the STF.

Others 166 provisional freedoms were granted after the end of the instruction hearings held in July, three revocations of arrest were granted in September, and one in October.

Furthermore, 11 people had their arrest revoked after the death of trader Cleriston Pereira da Cunha, aged 46, who died on November 20th in Papuda. One of these people is doctor Frederico Rosário Fusco de Oliveira, aged 60, who suffers from cardiac arrhythmia.

In addition to the colonel, farmer Jorginho Cardoso de Azevedo, 63 years old, is also in prison and ill. He has several comorbidities in his spine, including eight metal pins due to a serious injury. “His health condition is critical and he must undergo continuous medical treatment”, state medical reports sent by the defense to the STF, which cite the risk of paraplegia if the elderly person does not receive adequate care.

Lawyer Gislaine Alves Yamashita mentions that the elderly person’s severe pain and the environment to which he is exposed, with the certainty that no crime has been committed, also harmed his mental health. “Seu Jorginho has severe depression and frequent panic attacks”, reported the lawyer, mentioning that the man has “attempted on his life” and hit his head heavily on the glass during meetings with the defense. “The situation is extremely delicate”, she concluded, asking for help.
