Zanin assumes rapporteur for Bolsonaro’s appeal at the STF

The Minister of the Federal Supreme Court (STF) Cristiano Zanin will be the rapporteur of the appeal that tries to reverse the ineligibility of the former president Jair Bolsonaro (PL). Zanin, who took office as minister in August 2023, appointed by President Luiz Inácio Lula da Silva (PT), was chosen for the rapporteurship in distribution held on the 19th. The former president’s appeal to the STF has been in progress since October, when the defense requested a review of the ineligibility declared by the Superior Electoral Court (TSE). The decision of the TSE Plenary was taken in June, by 5 votes to 2, declaring Bolsonaro ineligible for eight years, counting from the 2022 elections. Before appealing to the STF, the former president tried to appeal to the TSE, which was denied.

The draw that resulted in Zanin being chosen to report on Bolsonaro’s appeal excluded ministers Alexandre de Moraes, Nunes Marques and Cármen Lúcia. In accordance with the rules of the Internal Regulations of the STF (RISTF), the distribution of cases through a draw is carried out by a computerized, public and accessible system, which distributes the cases automatically and randomly.

The draw, however, follows some rules, such as preventing distribution to the president of the STF or the vice-president, when he is occupying the position, and carrying out a new draw if the minister is declared a suspect or prevented from reporting the case. , as long as it fits into the cases provided for by law.
