Lawyer Cristiano Zanin was approved by the STF (Federal Supreme Court) to fill the vacancy of Ricardo Lewandowski with 58 votes in favor and 18 against.

Appointed by President Lula (PT), he was questioned this Wednesday (21) by a Senate with no recent history of rejections with the ninth largest gap between court votes, tied with Minister Dias Toffoli.

After going through the CCJ (Constitution and Justice Commission) of the Senate, an absolute majority of the votes of the senators in plenary is enough for the nomination to be ratified. In this case, 41 votes in favor of the 81 total.

Among the ministers approved with the greatest clearance is Luiz Fux, nominated in 2011 by Dilma Rousseff (PT). The magistrate was part of the STJ (Superior Court of Justice) and achieved the highest number of votes since 1989, with 68 favorable senators and 27 votes in relation to the cutoff note. He received only 2 votes against.

In second place comes Ellen Gracie, nominated by Fernando Henrique Cardoso (PSDB) in 2000. She had the approval of 67 senators and no opposition to her nomination, with a margin of 26 votes.

Appointed by Lula in 2003, Joaquim Barbosa occupies the third position, with 66 favorable votes and 25 votes in relation to the cutoff score. He had 3 positions against his nomination.

Also appointed by the current president, Carlos Ayres Britto and Ricardo Lewandowski were appointed in 2003 and 2006, respectively. Britto ranks fourth, with 65 favorable votes, with 24 off, followed by Lewandowski, who received approval from 63 senators, with 22 votes off.

The last time the House rejected a name from the Court was in 1894, when it barred five chosen by then President Marshal Floriano Peixoto.

The closest to that since 1989 was Francisco Rezek, approved by 45 votes to 16, just four more than the required 41. Appointed by Fernando Collor in 1992, Rezek had already joined the STF in the early 1980s and left the court to take over a government ministry.

Celso de Mello, nominated in 1989, comes in second, followed by André Mendonça, whose score is equal to his. He entered the highest body of the Judiciary in December 2021, with 47 votes in favour, just six more than necessary, and 32 votes against.

Second choice of Jair Bolsonaro (PL) for the Brazilian Supreme Court, Mendonça had the third worst performance in the Senate and received the fewest votes in favor in the Senate among all the current members of the STF.
