With STF under fire, Gilmar questions the slowness of the Military PEC – 11/25/2023 – Panel

In his speech on Thursday (24), one day after the approval in the Senate of the PEC (Proposed Amendment to the Constitution) that limits the individual decisions of ministers of the STF (Supreme Federal Court), minister Gilmar Mendes embedded a message that had the Legislature and the Armed Forces as targets simultaneously.

Mendes recalled that the problem of political participation by the military remains unregulated even after the several attacks by members of the Armed Forces on democratic institutions in recent years, which led to the coup attacks on January 8th. The minister used an ironic tone to say that it has now been discovered that the great threat to democracy in Brazil is the STF.

Discussed in the Lula (PT) government since the beginning of the mandate, the PEC dos Militares emerged with the proposal to force them to retire to contest elections or assume ministry. However, it has been processed slowly, has been dehydrated and should only determine that members of the Armed Forces be transferred to the reserves if they decide to launch candidacies.

It would be voted on on Wednesday (22) in the Senate Constitution and Justice Committee, but the senators asked for more time for analysis.

“The threats that came from sectors of the Armed Forces against this court and against democracy do not deserve a response. Until now, the military remains eligible. No solution in this regard. Police officers continue to pursue a career, get elected, and then return to the force. None response in relation to issues that are urgent for democracy. The problem is the STF and its injunctions. Strange priority”, stated Mendes.

In reaction to the approval of the PEC that targets the STF, Mendes said that the court is not made up of cowards or fearful people and that ministers will not submit to the “authoritarian heel” that, according to him, represents the amendment approved by the Senate. He even called the PEC’s sponsors “moral pygmies”.
