Will Congress approve alternatives to collect the new CBS and IBS taxes?  – 02/09/2024 – What tax is this

The National Congress chose to place the current tax collection model as the main way of managing the CBS and IBS created by the tax reform. But it left room for alternatives that reduce the risk of default and, consequently, allow for a lower tax rate.

Based on this assessment, the CCiF (Center for Fiscal Citizenship) presented this Thursday (8) a technical note with four models for collecting the new taxes.

The director of the Fiscal Citizenship Center Nelson Machado highlights that the note is in line with the legislator’s decision to place the current system as the main rule. In other words, it is up to the supplier to collect the taxes and the buyer’s credit is independent of this payment.

This does not mean that Parliament cannot give freedom to use some alternatives. For example, the use of “split payment” in purchases made by individual consumers by electronic means.

It would also be possible to transfer the payment obligation to the acquirer in situations where there is room for fraud. This would be applied to purchases made by some taxpayers who have a high volume of credits to receive, such as exporters, and to the acquisition of some services that are more sensitive to prove, according to the CCiF.

It would also apply to sales by Simples Nacional companies, which do not adhere to the new system, to CBS/IBS taxpayers — freeing these small companies from this obligation.
