Valdemar is denounced to the PGR for coup decrees – 01/30/2023 – Mônica Bergamo

The national president of the PL, Valdemar Costa Neto, was denounced to the Attorney General’s Office (PGR) and to the Electoral Attorney General’s Office (PGE) for allegedly committing crimes against the democratic rule of law. The party leader became the target of two representations after claiming that there were proposals for coup decrees “in everyone’s house” against the result of the 2022 elections.

Earlier this month, the Federal Police found a draft decree at the residence of former minister Anderson Torres for then-president Jair Bolsonaro (PL) to establish a state of defense at the headquarters of the TSE (Superior Electoral Court). The objective, according to the text, was to reverse the result of the election, in which Lula (PT) won.

In an interview with the newspaper O Globo, Valdemar Costa Neto confirmed that similar proposals circulated around the former president. “That proposal that was in the Justice Minister’s house, that was in everyone’s house”, he said, adding that Bolsonaro “did not want to do anything outside the law”.

For the Prerogatives group, which is composed of lawyers, jurists and defenders and signs the representations, it is necessary to investigate the origin, authorship and content of the documents cited by Valdemar.

“It seems that not only former Minister of Justice Anderson Torres is responsible, directly or indirectly, for the attacks on democracy in the country,” lawyer Marco Aurélio de Carvalho, coordinator of Prerogativas, told the column.

“The statement [de Costa Neto] it is very embarrassing and has to provoke a rigid investigation process. Not only did he not help Anderson Torres, he ended up, in fact, putting himself in the crime scenes that attacked democracy, against the rule of law, against the independence of the powers that be,” he said.

According to the collective of lawyers, the existence of minutes of this nature would show that the attempt to carry out a coup d’état in Brazil was not an isolated fact and could have had the knowledge and consent of the PL.

“The participation of a party association, through its president, in such criminal events shows a direct violation of the constitutional bases in relation to political parties, as well as proves the creation of an organizational engendering that had several immoral and illicit stages”, states the Prerogatives to the PGR and the PGE.

“It is emphasized that the facts narrated in the interview show the participation of several public agents and lawyers in the elaboration and analysis of the coup documents”, he continues, suggesting that those investigated may be framed in the crime of criminal association.

The lawyers who sign the representations claim that Valdemar Costa Neto should be attentive and vigilant in relation to the rule established by the Constitution that requires political parties to respect the democratic regime. And they remember the attempt of the action presented by the PL, next to the TSE, asking that the votes registered by the electronic ballot boxes be invalidated.

“The aforementioned action had the consent and participation of the represented [Valdemar]demonstrating that in addition to the aforementioned drafts, he acted systematically and together with the former president to try to destabilize the electoral process”, they say.

The representations sent to the PGR and PGE are signed by the lawyers Guilherme de Salles Gonçalves, Marco Aurélio de Carvalho, Gabriela Araujo, Emma Roberta Palú Bueno and Geovane Couto da Silveira.

They also ask the PGR that Valdemar be investigated for allegedly destroying the coup minutes and failing to communicate their existence to the competent police authorities. The PGE, in turn, requests that the institutional use of the PL be investigated in favor of interests that intended to attack the rule of law.
