Universitario’s physical trainer will answer for racism in freedom

In a decision handed down this Thursday (20) by the TJ-SP, the judge accepted the complaint of the Public Ministry, made Vargas a defendant in the process, but allowed the professional of the Peruvian team to respond freely.

“Such a circumstance, it is worth noting again, does not remove the vile and disproportionate burden of the imputed act, but does not emanate from such an episode that the accused, when placed on provisional release, represents a danger to society or that puts public order at risk”, says part of the decision of judge Antonio Maria Patiño Zorz.

Now, Sebastián Avellino has up to five days to provide updated personal and telephone data of himself and his superiors at Universitario. According to the decision of Judge Antonio Maria Zorz, Avellino can appear in person or virtually at the hearings of the process.

UNDERSTAND THE CASE

Avellino was caught making racist gestures towards Corinthians fans in the first leg game between the team from São Paulo and Universitário for the playoffs for the round of 16 of the Sul-Americana.

After the match, the physical trainer went through a custody hearing at the Criminal Forum Minister Mário Guimarães, was arrested preventively and, since then, Avellino’s defense sought habeas corpus for the case.

On Wednesday, the São Paulo Public Prosecutor’s Office (MP-SP) filed two complaints with the court against the professional: for racism, with a punishment of up to five years, and for promoting turmoil and disorder at sporting events, which can lead to up to two arrests, according to the General Sports Law.

In the document to which Estadão had access, prosecutor Pedro Henrique Pavanelli Lima asks for the maintenance of Vargas’ preventive detention in the country until the final sentence of Justice. Arrested in the act while still at the stadium, the professional had his request for habeas corpus denied last week. As it has no ties with Brazil, the MP understands that it is important for the accused to remain in the country until the conclusion of the process.

In this Thursday’s decision, Judge Antonio Maria Patiño Zorz, of the TJ-SP, understands the seriousness of what happened, but points out that Avellino’s freedom does not jeopardize public order or be a danger to society. In this way, the physical trainer must respond to the Peru process.
