Physical trainer Sebastian Avellino Vargas, from Universitario, in Peru, had his preventive detention revoked this Thursday (20) and will respond to the criminal process for racism in freedom.
The professional had been detained since the last 11th, when he was arrested in the act at the Neo Química Arena, shortly after a match between the Peruvian team and Corinthians, for the Copa Sudamericana.
Videos circulating on social media show the Uruguayan taking a stand in front of the alvinegra fans and, apparently, imitating a monkey.
The TJ-SP (Court of Justice of São Paulo) accepted the complaint of the Public Prosecutor’s Office and made him a defendant. The judge, however, ruled that he could answer freely.
“Such a circumstance, it is worth noting again, does not remove the vile and disproportionate burden of the imputed act, but does not emanate from such an episode that the accused, when placed on provisional release, represents a danger to society or that jeopardizes public order”, says an excerpt from the decision of judge Antonio Maria Patiño Zorz.
Sebastian has five days to go to the registry office and provide updated contact information for him and his superiors at Universitario.
The day after the physical trainer was arrested, the Peruvian club released a note in which it defended the professional and stated that the arrest was arbitrary. “The honor of a professional in our club has been tarnished,” reads an excerpt from the statement.
When he had the arrest in flagrante delicto converted into preventive, the judge Roberto Porto, of the 4th Chamber of Criminal Law of the Court of Justice of São Paulo, stated in his decision that the analyzed images show that he made “clear and unequivocal gestures of the animal towards the Brazilian fans”.
