Union must pay pension to children of PT member killed in Foz – 02/14/2023 – Power

A decision by the Federal Court of Paraná obliges the Union to pay child support to the three underage children of Marcelo Arruda, the municipal guard and PT militant shot dead by Bolsonarist criminal police officer Jorge Guaranho in July 2022, in Foz do Iguaçu.

Responding to a request from Marcelo’s family, substitute federal judge Diego Viegas Veras, from the 2nd Federal Court of Foz do Iguaçu, determined that the Union pay the amount of R$ 1,312.16 for each of the three minor children, R $3,936.49 in total.

The decision was signed on Sunday (12). The report contacted the AGU (Attorney General of the Union), which has not yet commented on the matter.

In his decision, the judge points out that the STF (Federal Supreme Court) has recognized the responsibility of the State in cases like this. “I bow to the understanding of the Supreme Court to understand that there is omissive responsibility of the State regarding the acts performed by its servant, even if out of service, since the weapon belonging to the referring public entity is used.”

Guaranho is a federal public servant, linked to Depen (National Penitentiary Department), and the weapon used to shoot Marcelo was part of the Union’s arsenal. As a federal correctional officer, he carried a weapon, regardless of whether he was on duty.

The amount of alimony defined by the judge took into account Marcelo’s net salaries in July last year (R$ 8,735.65), discounting the amount of R$ 4,799.16, referring to a death pension that is already being paid dependents recognized by the municipal social security law. Marcelo was a public servant in Foz do Iguaçu.

Guaranho is in prison and is accused of double murder.

On the night of July 9 last year, the criminal police invaded Marcelo’s birthday party, which was celebrating his 50th birthday with a PT theme, and shot at the municipal guard. The petista, already wounded on the ground, also shot the Bolsonarist, who was admitted to a hospital before being transferred to prison.

Security cameras recorded the crime.
