Authored by the Public Ministry of Amapá (MP-AP), two more actions for administrative improbity were filed this Tuesday (7) in the Single Court of the District of Pedra Branca do Amapari against mayor Elson Belo Lobato, of Serra do Navio, accused of embezzling public resources from the municipality. The actions will be judged by judge Fabiana da Silva Oliveira, who in a previous action already determined the unavailability of the mayor’s assets up to the value of R$ 178 thousand.
In the first case, Elson Belo Lobato and Gabriela Machado Brito, secretary of the Municipal Treasury, are involved. According to the MPAP, Elson Belo authorized and made payments without provision in a normative act and, in the case of Gabriela, as secretary, she not only made the payments, but they were directed to herself, both incurring, therefore, in act of administrative improbity. Since the end of 2021, Gabriela Souza has received from the public coffers of Serra do Navio directly into her bank account several payments of R$3,896.89 or R$3,896.99, made by herself and the mayor, at a frequency of, at least two payments per month.
Asked about the payments, Gabriela Souza gave two versions. At first, she said it was a salary advance, however, after being questioned about the fact that she would receive not only the salary, but also another ‘advance’ the following month, she changed her version and stated that the amounts referred to “aid -health”, and confirmed that Mayor Elson Belo knew everything and participated in the payments using bank passwords.
According to a calculation made by Gabriela herself, undue payments made from 2021 to 2023 totaled R$57,960.54, without the incidence of late payment interest and monetary correction.
In the same action, the Public Ministry reveals that Zuleide Souza Machado, secretary Gabriela’s mother, lived in public property in the municipality that was transferred without complying with legal requirements. Later, the property was passed on to third parties upon receipt of values for it.
The Public Prosecutor’s Office is requesting the removal of Elson Belo Lobato for 90 days from the position of mayor of Serra do Navio to avoid the imminent practice of new crimes and the perpetuation of the current one, without prejudice to the possible renewal of the period of removal, and remembers that he is the target of at least ten actions of administrative improbity, and one of them seeks compensation for R$200,000 unduly diverted due to the fact that Elson handed over his access key and payment password to third parties, in addition to making payment requests via WhatsApp to their secretaries.
In the second action this Tuesday (7), the mayor of Serra do Navio is accused of embezzling the resources that should have been transferred to the bank under an agreement to grant a loan set aside on the payroll of municipal employees. During 2019 – the contract is from 2014 -, for example, it unduly withheld the amounts deducted from its employees’ payroll.
The value of the damage to the treasury resulting from the default caused by Elson’s management reaches a total of R$ 173,833.09, in repairing the property damage caused to the Serra do Navio treasury in the total amount of R$ 173,833.09.
