With a political career in Amazonas for 25 years, Silas Câmara (Republicanos-AM) is trying to save his fifth consecutive term as federal deputy. Accused of illicitly raising and spending financial resources in the 2022 electoral campaign, he had a special appeal accepted by the president of the Regional Electoral Court (TRE), judge Jorge Manoel Lopes Lins. The decision was published this Friday (19), in the TRE Electronic Justice Gazette and must be analyzed by the Superior Electoral Court (TSE).

According to the decision, the Chamber had its financial statements approved with reservations by TRE-AM, with the determination of the return of amounts to the National Treasury. With the admission of the special appeal, the Electoral Public Prosecutor’s Office has three days to offer counterarguments. After the deadline, the special appeal will be analyzed by the Superior Electoral Court.

O IN TIME He sought advice from the parliamentarian and is awaiting a position.

In December 2023, TRE-AM formed a majority in favor of revoking Silas Câmara’s mandate. The case’s rapporteur, judge Pedro de Araújo Ribeiro, argued that, due to the state’s logistical difficulties, irregularities became differentiating elements in the dispute of the election.

“For this reason, the proven irregularity of expenses incurred with aircraft chartering reveals an outstanding gravity, because it corresponds to the possibility of access to Municipalities and voters that are unreachable for the majority of candidates in the proportional election”, pointed out the rapporteur.

In addition to the vote to move forward with Silas’ impeachment, members of the regional Court also spoke out about the electoral and party recalculation, which disregards the votes won by Silas Câmara in the 2022 elections.

Impacts of revocation

In an interview with In timepolitical scientist Carlo Santiago, explained that if the revocation of the mandate is completed, the impacts of this measure will be directed not only at Silas’s party, but also at the Amazonian political scene, as a new recalculation of the electoral quotient will be carried out.

“As a result, Silas Câmaras loses his position and his party could lose another deputy, Adail Filho, due to this new count; and parties such as PL, by Alfredo Nascimento and Capitão Alberto Neto, and also União Brasil, by Saullo Vianna, Fausto Jr., and Pauderney Avelino, can win new seats in the Chamber of Deputies. It is a decision that will have an impact not only on the career of Silas Câmaras, of his party, if a negative judgment occurs against him, but will also have an impact on the configuration of the Federal Chamber of Amazonas, for the Chamber of Deputies”

declared the expert.

This is not the first time that the Chamber has been the target of allegations involving the use of public resources for personal benefit, as previously, the federal deputy was accused of participating in a “rachadinha” scheme.

The Attorney General’s Office (PGR) accused federal deputy Silas Câmara of diverting resources from the Chamber to pay for advisors – a practice known as “rachadinha” – in the years 2000 and 2001, and also for having appointed employees who provided services as public servants. individuals.

Since then, the deputy was facing the case for embezzlement, but the action was dismissed by Minister Luís Roberto Barroso, of the Federal Supreme Court (STF), after the parliamentarian signed a non-criminal prosecution agreement (ANPP) with the Attorney General’s Office. in Criminal Action (AP) 864, which consisted of the payment of a fine of R$242 thousand.

This agreement was registered in the records one day before the statute of limitations and was approved by the rapporteur on the same day. In 2016, the Federal Supreme Court (STF) condemned the evangelical politician for using a false document and ideological falsehood.

According to the complaint, in 1997, Silas asked a dispatcher to change his civil registration, including his mother’s surname. In possession of the new identity document, she obtained a new identity card and new registration in the Federal Revenue Service’s Individual Taxpayer Registry (CPF), configuring ideological falsehood. Still according to the accusation, with the new documents, the deputy changed the articles of incorporation of the company of which he was a partner, configuring the use of a false document, in order to get rid of inconveniences related to his real name. Only when the accusations became public did the parliamentarian inform the authorities about the duplicity and arrange for the cancellation.

In response, the defense stated that the parliamentarian only intended to honor his mother and would have used the documents in good faith. Another point defended is that as soon as the Chamber became aware of the forgery, the parliamentarian would have informed the Amazonas Security Secretariat and the Federal Revenue of the facts to cancel the duplicate documents.

Sentenced to eight years in prison, the sentence was not served by the deputy due to the statute of limitations.
