With a political career in Amazonas for 25 years, Silas Câmara (Republicanos-AM) is trying to save his fifth consecutive term as federal deputy. Accused of illicitly raising and spending financial resources in the 2022 electoral campaign, he had a special appeal accepted by the president of the Regional Electoral Court (TRE), judge Jorge Manoel Lopes Lins. The decision was published this Friday (19), in the TRE Electronic Justice Gazette and must be analyzed by the Superior Electoral Court (TSE).

According to the decision, the Chamber had its financial statements approved with reservations by TRE-AM, with the determination of the return of amounts to the National Treasury. With the admission of the special appeal, the Electoral Public Prosecutor’s Office has three days to offer counterarguments. After the deadline, the special appeal will be analyzed by the Superior Electoral Court.

The Attorney General’s Office (PGR) accused federal deputy Silas Câmara of diverting resources from the Chamber to pay for advisors – a practice known as “rachadinha” – in the years 2000 and 2001, and also for having appointed employees who provided services as public servants. individuals.

Since then, the deputy was facing the case for embezzlement, but the action was dismissed by Minister Luís Roberto Barroso, of the Federal Supreme Court (STF), after the parliamentarian signed a non-criminal prosecution agreement (ANPP) with the Attorney General’s Office. in Criminal Action (AP) 864, which consisted of the payment of a fine of R$242 thousand.

This agreement was registered in the records one day before the statute of limitations and was approved by the rapporteur on the same day. Barroso justified that it was proven in the records that the amounts were paid within the period stipulated in the agreement, and this information was supported by the PGR.

Ideological falsehood

In 2016, the Federal Supreme Court (STF) condemned the evangelical politician for using a false document and ideological falsehood.

According to the complaint, in 1997, Silas asked a dispatcher to change his civil registration, including his mother’s surname. In possession of the new identity document, she obtained a new identity card and new registration in the Federal Revenue Service’s Individual Taxpayer Registry (CPF), configuring ideological falsehood. Still according to the accusation, with the new documents, the deputy changed the articles of incorporation of the company of which he was a partner, configuring the use of a false document, in order to get rid of inconveniences related to his real name. Only when the accusations became public did the parliamentarian inform the authorities about the duplicity and arrange for the cancellation.

In response, the defense stated that the parliamentarian only intended to honor his mother and would have used the documents in good faith. Another point defended is that as soon as the Chamber became aware of the forgery, the parliamentarian would have informed the Amazonas Security Secretariat and the Federal Revenue of the facts to cancel the duplicate documents.

Sentenced to eight years in prison, the sentence was not served by the deputy due to the statute of limitations.

Administrative dishonesty

In 2018, Silas Câmara and his wife, Antônia Lúcia, were convicted of administrative misconduct. The decision showed that Antônia spent almost R$63,000 on the telephone bill for her husband’s institutional device.

According to G1, the couple was convicted in the first instance by federal judge Herley da Luz Brasil. In 2011, the Federal Public Ministry denounced Silas and Antônia for the alleged practice of administrative improbity. The Public Ministry found that Lúcia used her husband’s corporate cell phone for private purposes, spending an additional R$63,000 on telephone bills.
