TSE starts trial that could lead to Bolsonaro’s ineligibility

The Superior Electoral Court (TSE) begins this Thursday (22) the trial of the lawsuit filed against former President Jair Bolsonaro. The action deals with the meeting of the then president with ambassadors, held in July last year, at Palácio da Alvorada, to attack the electronic voting system. If he is convicted, Bolsonaro will be ineligible for eight years and will not be able to run in the next election.

In the action, Bolsonaro is accused of abuse of political power and misuse of the media for having broadcast the meeting through TV Brasil. After the meeting was held, the PDT filed an investigation at the TSE.

Then, in a preliminary manner, the court ordered the removal of the images of the meeting from social networks and the official transmission of the event, as it understood that untrue and out-of-context facts were disclosed about the voting system.

In an opinion sent to the TSE, the Electoral Attorney General (PGE) defended that Bolsonaro be condemned. For the agency, the former president disclosed to the ambassadors untrue information about the elections.

During the course of the action, Bolsonaro’s defense defended that the case could not be judged by the Electoral Justice. According to the lawyers, the event with the ambassadors was held on July 18, when he was not an official candidate for the 2022 elections and had not yet been approved at a party convention.

The trial is scheduled to start at 9am. At the beginning of the session, the rapporteur of the process, Minister Benedito Gonçalves, will read the report of the action, a document that summarizes all the stages covered by the process. Then, PDT and Bolsonaro lawyers will have 30 minutes to speak.

The next to speak will be the Deputy Electoral Attorney, Paulo Gonet. The floor will return to Benedito Gonçalves, who will begin reading the vote.

After the position of the rapporteur, the other Justices start to vote in the following sequence: Raul Araújo, Floriano de Azevedo Marques, André Ramos Tavares, Cármen Lúcia, Nunes Marques and the President of the Court, Alexandre de Moraes.

The expectation is that the trial will not end today. In addition to this Thursday’s session, the TSE reserved two more to judge the cause. The sessions are scheduled for the 27th and 29th of this month.

If a minister makes a request to suspend the trial, the deadline for returning the case for judgment is 30 days, renewable for another 30. With the recess of July in the superior courts, the deadline would rise to 90 days.
