TSE does not notify internet users fined in June by Alexandre de Moraes

Two profiles from X, the former Twitter, sentenced by the president of the Superior Electoral Court (TSE), Alexandre de Moraes, to pay a daily fine of R$ 20 thousand “dissemination of disinformation against the elections and support for military intervention” have not been located for subpoena since the minister’s decision on June 1st of this year.

According to the case records, the accounts registered on the social network by users Wagner Pereira and Rita de Cássia Serrão were reactivated along with other profiles from the former Twitter, after the removal of posts with false information. However, the Special Advisory to Combat Disinformation pointed out that there was a recurrence in the use of both profiles to publicize against the electoral process “to the detriment of the popular will registered in the 2022 Elections”.

According to Minister Alexandre de Moraes, the daily fine of R$20,000 was imposed in “hypothesis of reiterating the dissemination of blocked content or publishing other messages instigating or encouraging a military coupattacks on Electoral Justice and the Democratic Rule of Law”, which would have been carried out by the two profiles with posts on May 1st, attached to the process.

At the time, the president of the TSE determined the “immediate removal of links” by Twitter under penalty of a fine of R$ 150 thousand per hour of non-compliance. The company responsible for the social network was notified on June 5th. The aforementioned posts were removed from the air while maintaining the profiles of the convicts, who have not yet been summoned by the Electoral Court. If the period from May 1st until the removal of the links by the social network is taken into account, the fine against users would exceed R$600,000 for each profile.

But so far, those responsible for the publications have not been notified by the TSE, according to the information in the process, which had its confidentiality removed by Alexandre de Moraes. In October, the minister informed that the Processing Coordination did not locate the addresses for subpoena of those involved. Therefore, Moraes forwarded the process to the Electoral Inspectorate “to inform the respective addresses contained in the Electoral Register.”

Inspector General Benedito Gonçalves responded that the Coordination of Judicial Affairs (Coaju) “presented the address of voter Rita de Cássia Serrão and reported that ‘several inscriptions were located in the name of Wagner Pereira, making it necessary to provide the date of birth or the voter’s maternal name, or his electoral registration number’, data not included in the records.”

In the last order, on November 16, Alexandre de Moraes ordered the case to be returned to the “Special Advisory Board for Combating Disinformation to identify the holder of the profile called Wagner Pereira.” Wanted by People’s Gazette, the user “wagnerP85638598” did not respond to the interview request. In X’s profile, he states that he is a logistics analyst, technical designer, patriot and conservative.

Rita de Cássia Serrão confirmed that she has not yet been summoned, but that she is in contact with a lawyer for guidance on the case. She claims that the post, targeted by the TSE, had only 61 views. “For those who don’t know, this is my situation, yes, I’m in need because of this”, he posted on social media this Sunday morning (3) when sharing the news about the amount of the fine.

The report found that members of a group in
