Minister Dias Toffoli, of the Federal Supreme Court (STF), will be the rapporteur for the defense request of Deputy Deltan Dallagnol (Podemos-PR) to suspend the effects of the candidacy registration challenge. The parliamentarian appealed to the STF against the decision of the Superior Electoral Court (TSE).

The choice of rapporteur was made by drawing lots. The ministers who are part of the TSE did not participate: Alexandre de Moraes, Cármen Lúcia and Kassio Nunes Marques.

The defense stated that the parliamentarian is a “currently controversial character in the Brazilian political scene”, as he collected a series of “enmities” throughout his performance as Lava Jato prosecutor. In addition, the lawyers allege that the TSE contravened “fundamental constitutional precepts”.

The Electoral Justice annulled Deltan’s candidacy registration and, as a result, he lost his mandate in the Chamber of Deputies. The former Lava Jato prosecutor, however, was not deemed ineligible for later elections. In practice, the objective of the defense is that the STF ensures that he remains in office until the legal dispute in the Electoral Court has a final decision.
