Toffoli maintains in the STF investigation of whistleblower against Moro – 06/06/2023 – Power

Minister Dias Toffoli, of the STF (Federal Supreme Court), confirmed the court’s competence to investigate the accusations of businessman and former state deputy Tony Garcia involving Senator Sergio Moro (União Brasil-PR) and public prosecutors in Paraná.

With that, Toffoli also determined the suspension of all processes in which the businessman appears as a party in the Federal Court of Paraná and in the TRF-4 (Federal Regional Court of the 4th Region).

The decision was signed on Monday (5). In addition to determining the suspension of the proceedings, the minister also requests a full copy “of all the facts in which he appears as a party, witness or investigated to the Federal Supreme Court, not being able to pronounce any decision in the referred records, not even those of a character urgent”.

Last week, Garcia said that he was forced to record people illegally at the request of state prosecutors and former federal judge Sergio Moro after signing an award-winning collaboration agreement in 2004, in the wake of the Consortium Nacional Garibaldi case, in which he was accused of fraudulent management.

“I was their undercover agent,” Garcia said in an interview with Sheet, on Friday (2). Moro claims that the businessman makes a “lying report and dissociated from any support in reality or in any evidence”.

The alleged illegalities would have occurred especially between 2005 and 2006 and, according to Garcia, they were informed to federal judge Gabriela Hardt, of the 13th Court of Curitiba, in a hearing held in 2021, when the businessman was trying to convince her that the termination of the his plea bargain was unfair. The agreement was terminated by the magistrate at the end of 2022 in response to a request from the MPF (Federal Public Ministry).

But, according to Garcia, Judge Hardt would not have taken action on the content of the complaints. In April of this year, Judge Eduardo Appio, then responsible for the 13th Court of Curitiba, took the reports and forwarded them to the STF.

Appio has been away from duty since last month, under suspicion of disciplinary infraction in an episode involving a federal judge whose son is a partner of Moro.

Judge Hardt, on the other hand, declined to comment on her role in the case, but this Monday, she said she had filed a criminal complaint with the MPF against Garcia for a crime against honor. She then declared herself a suspect in order to continue prosecuting his cases.

Without the plea agreement, the lawsuits against Garcia had resumed and the businessman was also obliged to transfer to the Union a property that had been given as collateral. Now, by order of Minister Toffoli, all processes are suspended.
