Deputies criticize the decision of the Chamber of Deputies on Dallagnol

The decision of the Board of Directors of the Chamber of Deputies to confirm the impeachment of the mandate of federal deputy Deltan Dallagnol (Podemos-PR) was criticized by parliamentarians heard by the People’s Gazette. They stressed that the interference of the Judiciary in the Legislative power is worrying. The decision to withdraw Dallagnol’s mandate was taken in May by the Superior Electoral Court (TSE) and ended up endorsed by the Legislature this Tuesday (6).

For Deputy Diego Garcia (Republicanos-PR), Parliament is experiencing a very delicate moment. “First on the merits of the decision, which there is a lot of disagreement, divergence. I think that it should wait until a possible appeal that the deputy makes to the Supreme Court, so that then the Chamber can express its opinion on the subject ”, he evaluated.

“I think that we are advanced in a very big power struggle between the Legislative and Judiciary, that we don’t know what the end will be. Today it was Deltan, tomorrow it could be anyone who can be judged by assumption”, added Garcia.

Ricardo Silva (PSD-SP) was also uncomfortable with the Board of Directors’ decision. “In my view, it is the people who should revoke the mandate of a parliamentarian, through their representatives. Of course we owe respect to the TSE, we owe respect to the Supreme Court, but there comes a time when the Chamber cannot be weakened”. “The Chamber has its internal regulations, it cannot degrade itself as a submissive power”, added the congressman.

The meeting of the Board of Directors – composed of deputies Arthur Lira (PP-AL), Marcos Pereira (Republicanos-SP), Sóstenes Cavalcante (PL-RJ), Luciano Bivar (União-PE), Maria do Rosario (PT-RS), Júlio Cesar (PP-PI), and Lucio Mosquini (MDB/RO) – was scheduled at the last minute, after the Corregedoria delivered, without merit analysis, the opinion on the case.

The note from the Board of Directors reported that “in the event of decree of loss of mandate by the Electoral Justice (art. 55, item V), there is no decision on the merits or judgment by the Plenary of the House. The competence of the Chamber of Deputies, exercised by the Board of Directors under the terms of § 3 of art. 55 of the Federal Constitution, is to declare the loss of mandate. This is the case of Deputy Deltan Dallagnol”.

Deputy Renata Abreu, national president of Podemos, said that the party will appeal to the STF with a request for an injunction. The understanding of the acronym is that Dallagnol was not entitled to full defense and contradictory.

In plenary, Reinhold Stephanes, Evair de Melo, and Marcel van Hattem lamented the confirmation of Dallagnol’s loss of mandate this Tuesday.
