Toffoli denies Dallagnol’s appeal to reverse the impeachment of the mandate

The Minister of the Federal Supreme Court (STF) Dias Toffoli denied this Wednesday (28) the request of former federal deputy Deltan Dallagnol (Podemos-PR) to suspend the decision that revoked his mandate. In May, the Superior Electoral Court (TSE) unanimously revoked the candidacy of the former Lava Jato prosecutor.
The Electoral Court understood that the former parliamentarian tried to circumvent the Clean Record Law by asking for his resignation from the position of public prosecutor during the course of open disciplinary actions to determine his conduct in the conduct of the operation processes.
In the decision, Toffoli considered that there were no irregularities in the decision of the TSE, informed Agência Brasil. “Fraud, in its various faces and nuances, has been discussed and faced in electoral proceedings with a view to maintaining and safeguarding the legitimacy, normality, morality and health of electoral competition, with no offense to the principles of legal certainty, trust or of electoral annuality”, wrote the minister.
During the trial at the TSE, Deltan Dallagnol’s defense claimed that he was able to run for election. The lawyers also stated that the request for dismissal was made after the National Council of the Public Prosecutor’s Office (CNMP) provided a certificate confirming that there were no ongoing proceedings against him. With the impeachment of Dallagnol, the vacancy in the Chamber of Deputies was occupied by Luiz Carlos Hauly (Podemos-PR).
