TJ de Minas lobbying office: who pays the bill? – 02/21/2023 – Frederico Vasconcelos

Exactly one year ago, Gilson Lemes, then president of the TJ de Minas, promoted at Restaurante Lago, in Brasília, a “fraternization dinner for the inauguration of the Representative Office of TJ-MG” in the federal capital.

The invitation was also signed by the president of the Association of Magistrates of Minas Gerais, Luiz Carlos Rezende e Santos.

At the end of his term, Lemes created the office, used to make political contacts in the Three Powers and personally lobby for the re-election of Jair Bolsonaro. He aspired to be appointed to the STF or STJ.

A year later, the president of TJ-MG, José Arthur Filho, ordered the closure of the office and the return of Lemes to jurisdictional activities. He said the office was “extremely helpful” but employed to cause rifts.

It remains to be seen who will pay the lobby bill. The TJ-MG rented property from the National Confederation of Commerce (R$607,000 over five years). The State could have ceded idle space in the JK Building, close to the site.

But Lemes was not alone.

The inauguration of the office reflected the euphoria with the creation of the TRF-6, in Belo Horizonte, which generated competition for vacancies for judges, lawyers and members of the MP. The new court was a platform for Bolsonaro, a candidate for re-election.

They were at the inauguration of the office João Otávio de Noronha, father of the TRF-6 project; the Attorney General of Justice, Jarbas Soares Júnior, the president of the OAB-MG, Sérgio Rodrigues Leonardo, and the then president of the AMB, Renata Gil.

30 judges attended, in addition to judges, servants, parliamentarians, lawyers, members of the Military and Civil Police, the Army and Freemasonry.

Weeks earlier, Lemes had received federal deputy Eduardo Bolsonaro (PSL-SP) in court, who recalled the fact at the inauguration. “It’s always good to see the Judiciary getting closer to Brasilia,” he said.

Lemes approached Jair Bolsonaro.

He went to the event at the Federation of Industries in which Governor Romeu Zema formalized his support for Bolsonaro’s re-election. Lemes’ wife, Aliny Kássia e Silva, campaigned with Michelle Bolsonaro and Damares Alves.

Complaint and disagreements

On the agenda of the CNJ session on the 28th is the judgment of a disciplinary complaint to investigate possible infractions by Rudders in the rent of the office.

The rapporteur is the national inspector, Luis Felipe Salomão. The procedure was opened in June 2022 by the predecessor, Maria Thereza de Assis Moura.

After a court inspection, she praised the management of José Arthur, who had taken over 22 days earlier.

Carlos Vieira Von Adamek, coordinator of the inspection, said that “some good practices developed in Minas may be projected to other courts”.

José Arthur was a judge of the TRE-MG in the class of lawyers. He was successful in law before going to the magistracy for the fifth.

Lemes was elected with the support of former president Nelson Missias. Later, there was a breakup. Lemes made the successor, José Arthur, who defeated the disembargator Mariangela Meyer, candidate of Missias.

On the last 7th, in a virtual session, 78 judges of the Plenum approved the granting of the Judicial Merit Necklace to Rosa Weber, Maria Thereza de Assis Moura and Rodrigo Pacheco. There were four dissenting votes.

On the 8th, judge Marco Aurelio Ferenzini, linked to Messias, asked the CNJ to open disciplinary proceedings against Lemes and José Arthur. He requested the closure of the Brasilia office, which he considered “an excrescence”.

In the complaint to the CNJ, Ferenzini commented that Missias, “during his administration, did not need or consider a representation office in Brasília and, whenever necessary, made contacts with authorities in a republican way” (…) “incidentally, like all previous presidents” .

On the same day, José Arthur visited Rosa Weber, president of the CNJ, and the national corregidor, Luis Felipe Salomão. The hearings were seen as an attempt to shield the president.

About the meeting with the magistrate, the TJ-MG published that Salomão “has a magnificent trajectory in the judiciary and that he is always willing and attentive with the magistrates of Minas Gerais”.
