ADPF 442, authored by PSOL together with Instituto Anis, was presented to the STF in March 2017 and asks that the articles of the Penal Code that treat abortion as a crime be considered unconstitutional. Today, according to the Penal Code, abortion is a crime, not punished when the pregnancy is the result of rape or when there is a risk to the mother’s life. In 2012, the STF defined that the abortion of anencephalic fetuses should also not be punished.

The deputy from Minas Gerais made the speech directed to the president of the STF, minister Rosa Weber, who is the rapporteur of the action at the Supreme Court. The minister intends to put the ADPF on trial before her retirement on October 2nd. “It is despicable for a woman to leave a legacy of death for our country,” said Nikolas.

The parliamentarian also said that a baby at 3 months old, in the mother’s womb, is already fully formed, and with the action in the STF, they are trying to “kill innocent lives”. “She – the child – has a fingerprint, she has movements, even if involuntary, her heart beats, she has a brain. That child only differs from you, Minister Rosa Weber, in time and nutrition. During his speech, the deputy responded to some “laughter” from left-wing parliamentarians and feminists in the plenary who defend the legalization of abortion. “Get the laughter off your faces, because no one here is playing defense of life, no. Everyone who supports abortion has already been born,” he said.

In the end, he called on the Brazilian population, who are mostly against abortion, to take to the streets to defend the life of the unborn child. “We have to defend the lives of these children who could possibly be killed due to the stroke of a pen by a Minister and several Ministers”, he declared.
